!9/30 <br />of a wastewater discharge permit, the city manager may require <br />the nonresidential user to submit for approval, within such <br />time and with such modifications as the city manager deems <br />necessary, a detailed time schedule of specific actions which <br />the nonresidential user shall take in order to prevent or <br />correct the violation. <br />6.460 Revocation and Termination of Service. <br />~ 1 } Any nonresidential user who violates any of the <br />provisians of sections 6.400 to 6.470 of this code or the con- <br />ditions of its wastewater discharge permit, which violation <br />does not present an imminent danger to the health, property or <br />the environment or which violation will not cause damage to or <br />interference with the operation of the city sewerage system, <br />may have its wastewater discharge permit revoked and sewer con- <br />nection severed by order of the city manager. <br />~2} The order shall be signed by the city manager and <br />shall specify the nature and source of the violation. The <br />order shall be delivered or sent by regular mail to the address <br />of the nonresidential user as shown on the permit. The order <br />may specify the corrective actions to be taken and shall allow <br />reasonable time for satisfactory correction. If the permit <br />holder does not correct the violation within the time specified, <br />or such additional time as maybe allowed in writing by the <br />city manager, then the wastewater discharge permit shall be <br />revoked and the sewer connection severed as provided in the <br />order. Correction of the violation shall not preclude assess- <br />ment of monetary penalties. <br />~ 3 } The filing of an appeal. pursuant to section 6.46 5 <br />of this code shall stay enforcement of the action by the city <br />manager under this section pending final administrative action <br />on the appeal. This provision supplements and does not res- <br />trict other provisians of this code, laws or regulations auth- <br />orizing termination of service for delinquency in payment of <br />fees or charges. <br />~4} The city shall publish in a daily newspaper with <br />the largest daily circulation in the metropolitan area, not <br />less than annually, a list of those nonresidential users which <br />during the previous twelve months were determined to be res- <br />ponsible for significant violations of sections 6.400 to 6.470 <br />of this code or their wastewater discharge permits. This <br />notification will summarize enforcement action by the city <br />during the same twelve months. For purposes of this section, <br />a significant violation is one which remains uncorrected <br />forty-five ~ 45 } days after notification of noncompliance; <br />which is part of a pattern of noncompliance over a twelve <br />~l2} month period; which involves a failure to accurately re- <br />port noncompliance,• or which resulted in the issuance of a <br />cease and desist order. <br />ordinance -- 13 <br />
