ORDINANCE NO . 1 ~ ` "1 <br />AN ORDINANCE CQNCERNING PLANTINGS WITHIN PUBLIC <br />RIGHTS-OF-WAY; AMENDING SECTIONS 6.Q10 AND 7.635 <br />OF THE EUGENE CODE, 1971; AND DECLARI~'G AN <br />EMERGENCY, <br />THE CITY of EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. Subsection ~j} of Section 6.010 of the Eugene Code, <br />1971, is hereby amended to read and provide: <br />6.ola <br />~.j} vision abstractions. A tree, shrub, bush ar <br />plant higher than 1$ inches above the crown of the adja- <br />cent roadway in that portion of the roadway between the <br />property line and the curb line within 35 feet from the <br />intersection of curb lines, if extended, at any street, <br />avenue, or highway intersection. where curbs have not <br />been established, no such use of street area shall be <br />made within 25 feet of the intersection of property <br />lines if extended at any street, avenue, or highway <br />intersection. The terms "bush", "shrub", or "plant", <br />as used in this section shall include climbers and other <br />vegetation growing upon or supported by poles, wires or <br />trellises. <br />Section 2. Section 7.635 of the Eugene Code, 1971, is hereby <br />amended to read and provide: <br />7.635 Foliage -- Permit to Plant. <br />-- - _ ,,, <br />~l} ^No person sha~.l plant, or allow to be planted in <br />a public right-of~-way, pedestrrian right-of-way, or pedestrian <br />easement, a tree, shrub, ar plant without obtaining a permit <br />at least 14 days prior thereto. <br />~2} The parks and recreation director, or his or her <br />designee, shall approve the type, location, spacing, and number <br />of trees, shrubs or plants prior to issuance of the permit. <br />~3} A permit shall not be required hereunder for the <br />planting of any flowering or fruit bearing plant, other than a <br />tree, that meets the distance and height requirements of sec- <br />tion 7.6 3 0 . <br />Section 3. That the matters contained herein concern the public <br />welfare, and in order to insure the orderly processing of planting <br />permits, an emergency is hereby declared to exist, and this Ordinance <br />ordinance - 1 <br />
