ORDINANCE NO . 1 ~ ` "1 AN ORDINANCE CQNCERNING PLANTINGS WITHIN PUBLIC RIGHTS-OF-WAY; AMENDING SECTIONS 6.Q10 AND 7.635 OF THE EUGENE CODE, 1971; AND DECLARI~'G AN EMERGENCY, THE CITY of EUGENE DOES ORDAIN AS FOLLOWS: Section 1. Subsection ~j} of Section 6.010 of the Eugene Code, 1971, is hereby amended to read and provide: 6.ola ~.j} vision abstractions. A tree, shrub, bush ar plant higher than 1$ inches above the crown of the adja- cent roadway in that portion of the roadway between the property line and the curb line within 35 feet from the intersection of curb lines, if extended, at any street, avenue, or highway intersection. where curbs have not been established, no such use of street area shall be made within 25 feet of the intersection of property lines if extended at any street, avenue, or highway intersection. The terms "bush", "shrub", or "plant", as used in this section shall include climbers and other vegetation growing upon or supported by poles, wires or trellises. Section 2. Section 7.635 of the Eugene Code, 1971, is hereby amended to read and provide: 7.635 Foliage -- Permit to Plant. -- - _ ,,, ~l} ^No person sha~.l plant, or allow to be planted in a public right-of~-way, pedestrrian right-of-way, or pedestrian easement, a tree, shrub, ar plant without obtaining a permit at least 14 days prior thereto. ~2} The parks and recreation director, or his or her designee, shall approve the type, location, spacing, and number of trees, shrubs or plants prior to issuance of the permit. ~3} A permit shall not be required hereunder for the planting of any flowering or fruit bearing plant, other than a tree, that meets the distance and height requirements of sec- tion 7.6 3 0 . Section 3. That the matters contained herein concern the public welfare, and in order to insure the orderly processing of planting permits, an emergency is hereby declared to exist, and this Ordinance ordinance - 1
