Each policy required by these prOV1Slons <br />shall be written as a primary policy, not contributing with or in excess <br />of any cov~rage which the City may carry. The operator shall deliver <br />copies of each policy to the Airport Manager before beginning operations. <br />Each liability policy shall be written on an "occurrence" form with an <br />admitted insurance carrier licensed to do business in the State of <br />Oregon and shall contain an endorsement entitling the City to not less <br />than 30 days prior written notice of any material change, nonrenewal or <br />cancellation. The adequacy of all insurance required by these rules <br />shall be subject to approval by the Airport Manager. <br /> <br />6.3.13.1 Comprehensive General Liability. The operator <br />shall maintain a broad form comprehensive general liability insur- <br />ance policy with coverage of not less than $500,000 combined single <br />limit per occurrence, with aggregate of $1 million, for bodily in- <br />jury, personal injury or property damage. Such policy shall contain <br />a contractual liability endorsement to cover the operator's indem- <br />nification obligations under these rules. The policy shall also <br />contain an endorsement naming the City as an additional insured, in <br />a form satisfactory to the City, and expressly providing that the <br />interest of the City shall not be affected by the operator's breach <br />of the policy provisions. <br /> <br />6.3.13.2 Comprehensive Automobile Liability. The operator <br />shall maintain a comprehensive automobile liability insurance policy <br />on all motor vehicles regularly used at the Airport with coverage <br />of not less than $500,000 combined single limit per occurrence with <br />aggregate of $1 million for bodily injury, personal injury or prop- <br />erty damage. The coverage shall include both hired and non-owned <br />auto liability. The policy shall also contain an endorsement nam- <br />ing the City as an additional insured, in a form satisfactory to <br />the City, and expressly providing that the interest of the City <br />shall not be affected by the operator's breach of the policy provi- <br />sions. <br /> <br />6.3.13.3 Worker's Compensation Insurance. The operator <br />shall comply with the Oregon worker's compensation law by qualify- <br />ing as a carrier-insured employer or as a self-insured employer and <br />shall strictly comply with all other applicable provisions of such <br />law. The operator shall provide the City with the assurances that <br />the City may require that the operator is in compliance with the <br />worker's compensation law. This rule is not intended to require <br />worker's compensation by an operator for agents, when that coverage <br />is not required by state law. <br /> <br />6.3.14 Indemnification. An operator shall indemnify and hold the <br />City of Eugene and its officers, agents and employees, harmless from and <br />against all claims, actions, liabilities, costs, including costs of de- <br />fense, arising out of or in any way related to the operator's activities <br />at the Airport, the operator's failure to comply strictly with any pro- <br />vision of these rules or of the operator's lease or permit with the City, <br />or of any other actions or failure to act by the opertor and the opera- <br />tor's employees, agents, officers and contractors.
