<br />ADMINISTRATIVE ORDER NO. 58-92-02 <br />of the <br />City Manager of the City of Eugene <br /> <br />ESTABLISHING FEES FOR APPEALS TO THE HEARINGS OFFICIAL <br />PURSUANT TO SECTION 5.045 OF THE EUGENE CODE, 1971 <br /> <br />The City Manager of the City of Eugene finds as follows: <br /> <br />A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager of the <br />City of Eugene to determine and set fees and charges to be imposed by the City for <br />services, goods, use of municipal property, and licenses and permits. In accordance with <br />the procedures set forth therein, on December 13, 1991 I notified the Mayor and City <br />Councilors that I intended to establish a fee of $50.00 for appeals to the Hearings Official <br />from decisions subject to review under the procedures of Section 5.045 of the Eugene <br />Code, 1971, as set forth in the Notice of Intended Fees attached as Exhibit A thereto. <br />The Notice was also posted at two locations at City Hall on December 10, 1991, and <br />made available for interested persons at the office of the City Manager. The Notice <br />provided that written comments would be received thereon for a period of 15 days from <br />the first date of posting. No written comments were received within the time provided in <br />the Notice. <br /> <br />B. I find that the appeal fee of $50.00 is consistent with applicable policies and <br />directives of the City Council, the amount charged for comparable appeals, and is <br />necessary to recover the costs incurred by the City in processing such appeals. <br /> <br />On the basis of these findings, I order that: <br /> <br />1. A fee in the amount of $50.00 is hereby established for an appeal to the <br />Hearings Official from decisions subject to review under the provisions of Section 5.045 of <br />the Eugene Code, 1971. The finance officer or designee may waive the appeal fee if the <br />appellant demonstrates that he or she is indigent. <br /> <br />2. If the appeal is sustained, and an appeal fee was paid, it shall be refunded <br />to the appellant, or if the record reflects that another person paid the fee, to the person <br />who paid it. <br /> <br /> <br /> <br />, City Manage7 <br />/ <br />
