ORDINANCE Na. 19163 <br />AN ORDINANCE CONCERNING PROHIBITED CAMPING; <br />AMENDING SECTION 4.$15 OF THE EUGENE CODE, <br />l9?l; AND DECLARING AN EMERGENCY. <br />THE CITY OF EUGENE DOES ORDAIN AS FOEL,oWS: <br />Section 1. Section 4.815 of the Eugene Code, 19?l, is hereby <br />amended to read and provide: <br />4.815 Prohibited Camping. <br />~1} As used in this section: <br />~a} "To camp" means to set up or to remain in or <br />at a campsite. <br />fib} "Campsitef' means any place where any bedding, <br />sleeping bag, or other material used for bedding pur- <br />poses, or any stave or fire is placed, established or <br />maintained far the purpose of maintaining a temporary <br />place to live, whether or nvt such place incorporates <br />the use of any tent, lean-to, shack, or any other <br />structure, or any vehicle or part thereof. <br />~2} Tt is found and declared that: <br />~a} From time to time persons establish campsites <br />on sidewalks, public rights-~of-way, under bridges, and <br />so forth; <br />fib} Such persons, by such actions create unsafe <br />and unsanitary living conditions which pose a threat to <br />the peace, health and safety of themselves and the <br />community; and, <br />~c} The enactment of this provision is necessary <br />to protect the peace, health and safety of the city and <br />its inhabitants. <br />~3} Na person shall camp in ar upon any sidewalk, <br />street, alley, laver public right-of-way, park or any other <br />publicly-owned property or under any bridge or viaduct, unless <br />otherwise specifically authorised by this code or by declara- <br />tion of the Mayor in emergency circumstances. <br />Section Z, That the matters contained herein concern the public <br />welfare, health and safety and therefore, an emergency is hereby de- <br />Glared to exist, and this Ordinance shall, become effective immediately <br />upon its passage by the City Council and approval by the Mayor. <br />Passed by the City Council this <br />11th day of July, 1983 <br />,orb ~ ~~~' <br />City Record <br />Approved by the Mayor this <br />1.lth day of July, 1983 <br />Mayor <br />Ordinance. <br />
