X53-13 ~ <br />~~ <br />ORDINANCE N0. <br />AN ORDINANCE CONCERNING LAND USE CLASSIFICATION AND <br />AMENDING THE ZONING MAP OF THE CITY OF EUGENE, OREGON <br />THE CITY COUNCIL OF THE CITY OF EUGENE FINDS THAT: <br />Pursuant to the prove si ons of OR5 227.215 and Sections ~~~.27~8 and 9,668 <br />through, 9,684 of the Eugene Cade, 1971, the City Council has the authority <br />and responsi b i 1 i ty, subject to the 1 imi tati ons contained therein, to change <br />the zoning c1 assn f1 cats on of property within the City of Eugene; <br />Based upon the report of the Planning Comrni ssi on the materials tran s- <br />mi tted therewith, and the evidence presented before the P1 ann i n Commi ssi o n <br />g <br />and this City Cauncil , the request for zone change classification i s i n con- <br />formance w~ th the General Plan; there i s a pub1 i c need for the change i n zone; <br />and the publ ~c need can best be served by changing the classification of the <br />property; <br />t NOW; THEREFORE, <br />Based upon the foregoing, the City Counci 1 hereby adopts as its own the <br />specific affirmative findings contained i n the Planning Department staff notes <br />of August 2, 1983, and the Planning Co~nmi ssi on minutes of August 2, 1983, <br />for the reasons set forth therein, and <br />THE CITY DF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. As provided by Section 9.278 of the Eugene Code, 1911, the <br />zan~ng map an the zoning ordinance schedule of district changes are hereby <br />amended to refl ec:t the fo11 owi ng change of zone: <br />Tax Lots 1002, 1003, 1004, .1005, 1006, and 1007--ASSESSOr' s Map 17-04-35-0 0, <br />as more party cut arly descry bed on the attached Exhibit A, 1 oc ated on <br />the north side of West 11th Avenue, extending from Seneca Street east past <br />Tye nn Street, <br />Change of zone from I-2 Light-Medium Industri a1 district to C-21SR Community <br />Commerc i a1 district with Site Review procedures, said site review ~arocedures <br />addressing concerns as set forth i n Exhibit "B," attached. <br />Section 2.
