Prior to making a decision, the plan- <br />n~ng director may require an applicant to employ a licensed architect, land- <br />scape architect, engineer or other specialist if one or mare of those profes- <br />sional services is required for compliance with section 9.688 criteria. <br />~4} Planni n director decision. <br />~a} Unless the applicant agrees to a longer time period, the <br />planning director shall approve, conditionally approve, or deny <br />the site plan within 30 days of receipt of a complete and accurate <br />appli~cat~on. Approval shall be based on section 9.688 criteria, <br />and particularly when applicable, those criteria addressed at the <br />time of site review subdistrict rezoning. The planning director <br />shall mail a~copy of the decision to the applicant and parties who <br />have requested a copy on the date ~it is entered. <br />fib} 1f the request requires re-examination of existing stand- <br />ards or policies, the planning director may refer the matter to <br />the planning commission fora deci si an . <br />tc} Unless appealed, a planning director's decision is <br />effective on the eleventh day after it is rendered. <br />~5} Front yard, fence and wall waivers. When approving a site <br />plan, the planning director may permit waivers to the front yard require- <br />ments and the wall and fence provisions of this ordinance, provided: <br />~a} The waivers will not be materially injurious to properties <br />or improvements i n the vicinity; <br />fib} The development will be at least as attractive as could <br />be expected from standard requirements; <br />~c} There will be adequate vision clearance for traffic <br />passing on the street and leaving the development site; <br />(d} There will be adequate landscaping to make up for <br />screening or setbacks as would otherwise be necessary to com 1 <br />pY <br />with section 9.68$ criteria; and <br />fie} There will be adequate provision for protection of <br />the public's health and safety at least equal to what a standard <br />front yard and fence or wall would provide. <br />~6} Documentation of a raved laps. After site plan approval, <br />the applicant shall provide the planning department with three copies of <br />the approved plans. The planning department shall mark them "Approved" <br />with the date of the action. The planning department shall also attach the <br />conditions of approval to the plans. <br />~ 7} A~_proy,a,l Expiration . I f a building permit for a level opment <br />for which site plan and appli~cati~on approval has been granted is not obtain- <br />ed within ~8 months of the approval, unless an extension has been requested <br />and granted by the planning director within that time period, the approval <br />is automatically revoked and a new site plan and application must be sub- <br />mitted and approved prior to issuance of a building permit. <br />~8} ApLal, <br />~ a} Within ten days of the planning director's decision, i t <br />may be appealed to the hearings official by the applicant, or an <br />adversely affected person. <br />fib} An appeal shall be on a planning department form, shall <br />be based on the record, and shall state specifically haw the plan- <br />ning director failed to properly evaluate the proposed site plan <br />or. make a decision cansi stent with applicable criteria. <br />~c} Unless the applicant and appellant agree to a longer <br />ordinance -34- <br />
