C98 Candi ti anal Use Permit Prere ui si to to Bui 1 di n No bui 1 di ng <br />permit shall be issued when a conditional use permit is required <br />until the hearings official or commission approves a permit, and then only <br />in accordance with the terms and conditions of that permit. Conditional <br />use permits may be temporary ar permanent. <br />9.7oo Ap~i;cation. A conditional use permit application and related <br />information shall be submitted by the applicant, as prescribed by <br />the planning department, together with the fee set by the council. <br />9.702 .General Conditional Use Permit Criteria. A conditional use permit <br />may be granted only if the proposal conforms to all the following <br />criteria. Additional criteria may also be required depending on the appl i - <br />cability of other sections of this code, <br />~a} The location, size, design, and operating characteris- <br />tics of the proposed development will be made reasonably compati- <br />ble with and have minimal impact an the livability or appropriate <br />development of abutting properties and the surrounding neighbo r- <br />hood, with cansiderati,on given to harmony, scale, bulk, coverage, <br />and density; to oval 1 obi 1 i ty of publ i c foci 1 i ti es and utilities; <br />to traffic generation and the capacity of surrounding streets and <br />alleys; and to other relative impacts of the development. <br />fib} The location, design, and related features of the pro- <br />posed development will provide a convenient and functional living, <br />working, shopping or civic environment, and will be as attractive <br />as the nature of the use and its location and setting warrant. <br />~c} The proposed development will be consistent with appli- <br />cable adopted neighborhood refinement plans, special area studies, <br />and functional plans. <br />~d} The proposed development will be consistent with the <br />Metropolitan Area General Plan ~1} applicable land use references, <br />~2} text related to the development, and ~3} specific elements <br />related to the development. <br />fie} In the I-1, I-2, or I-3 districts, proposed commercial <br />uses will be dependent on yr at least provide a direct service to <br />people engaged in industrial uses. <br />9, lab Nvti ce_, Public Hearing, and Qeci si an <br />~~1} Un~l~ess the app~~i cant agrees to a i anger time peri od, a publ i c <br />hearing shall be scheduled on each application no later than 45 days after <br />receipt of a complete and accurate application. At least ten days prior to <br />the hearing, the planning department shall post a written notice of the hear- <br />ing and the nature of the request in at least three places within Soo feet <br />of the affected property and mail a written notice of the hearing and the <br />nature of the request to the applicant, owners and occupants of abutting <br />properties, and owners and occupants of properties adjacent to abutting prop- <br />erties. Properties abutting the area of an application include those separ- <br />ated from it by intervening streets or alleys. <br />~2} The hearings official may prescribe rules and regulations <br />for the conduct of the hearing, Unless the applicant agrees to a longer <br />Qrdinance -3~- <br />
