/9/9} <br />time period, the hearings official shall approve, conditionally approve, or <br />deny the application within ten days of the public hearing. The hearings <br />official's decision shall be based on findings and conclusions in response <br />to the criteria in section 9.10 and other applicable use permit criteria. <br />The hearings official shall mail a copy of the decision to the applicant <br />and parties who have requested a copy on the day it is rendered, <br />~3} If an application requires re-examination of existing stand- <br />ards or policies, the hearings official may refer the matter to the planning <br />commission far a decision . <br />~4} Unless appealed, the hearings official's decision is effec- <br />tive on the eleventh day after it is rendered. <br />9.108 Hearin s Official Authorized to Grant. variances in Conjunction <br />with a Conditional Use Permit. The hearings official may, in <br />connection with a conditional use permit application, grant variances to <br />the provisions of this ordinance with respect to fences and wal 1 s, site <br />area, width, frontage, depth, coverage, outdoor living area, front yard, <br />~nter~ar yards, height of structures, distance between structures, and off- <br />street parking facilities. The hearings official may grant a variance, if <br />on the basis of the application, investigation, and evidence submitted, the <br />hearings official makes findings as required fora variance from provisions <br />of this ordinance. <br />9.71o Conditions. The hearings official shall designate conditions <br />deemed. necessary and consistent with criteria for approval. The <br />hearings official may also require guarantees and evidence that the condi- <br />tions wi]1 be fulfilled. Conditions may include; <br />~a} Regulation of uses. <br />fib} Special yards, spaces. <br />~c} Fences and walls. <br />~d} Surfacing of parking areas to city specifications. <br />(e} Street dedications and improvements for bonds}. <br />~f} Regulation of points of vehicular ingress and egress. <br />fig} Regulation of signs. <br />~h} Landscaping and maintenance thereof. <br />~i} Maintenance of the grounds. <br />~j} Regulation of noise, vibration, offensive odors, <br />hazardous biological materials, and other nuisances to a greater <br />extent than set forth in sections 9.636 to 9.66 if necessary to <br />conform to the general conditional use permit approval criteria. <br />~ k} Regu1 ati on of time for certain activities. <br />~l} Time period within which the proposed use must be <br />developed, <br />gym} duration of use. <br />fin} Other conditions that will help the city to develop <br />and change in an orderly and efficient manner. <br />9.114 A eats. within ten days of the hearings official's decision, <br />it may be appealed to the planning commission by the applicant, <br />an adversely affected person, or a party entitled to notice. The appeal <br />shall be on a planning department form, shall be based on the record, and <br />shall state specifically how the hearings official failed to properly evalu- <br />ate the proposed conditional use permit application or make a decision con- <br />sistent with applicable criteria. <br />Ordinance -37- <br />
