ORDINANCE N0. ~~~ <br />AN ORDINANCE AUTHORIZING THE INSTITUTION OF PRO- <br />CEEDINGS IN EMINENT DOMAIN FOR THE ACQUISITION <br />BY CONDEMNATION OF FEE SIMPLE TITLE FOR THE <br />WIDENING OF ROOSEVELT BOULEVARD FRAM WEST BELT- <br />LIivE ROAD TO MAPLE STREET; AMENDING ORDINANCE N0. <br />18865; AND DECLARING AN EMERGENCY. <br />The City Council of the Casty of Eugene finds that: <br />On September 14, 1981 the City Council authorized the institu- <br />tion of proceedings in eminent domain for the acquisition of prop- <br />erty interests far the widening of Roosevelt Boulevard from West <br />Beltline Road to Maple Street through the adoption of Ordinance No. <br />18865, which was approved by the Mayor on that date. <br />Subsequent to the adoption of Ordinance No. 18865, the City <br />Engineer has amended the original construction plans, and the <br />amended plan includes property not authorized for acquisition by <br />Ordinance No. 1SS65. <br />The Council specifically adopts the findings contained in <br />Ordinance No. 18865, and further finds that the amended plans of <br />the City Engineer Constitutes the mast beneficial and practical <br />location for the improvements and are in accordance with provisions <br />of the Eugene Code, 1971 and applicable policies and agreements of <br />the City of Eugene. Now, therefore, <br />THE CITY QF EUGENE DGES ORDAIN AS FOLLOWS: <br />Section 1. Based upon the above findings, and the findings <br />of Ordinance No. 18865, which are incorporated herein by reference, <br />the City Council hereby directs that Ordinance No. 18865 be, and <br />the same is hereby amended by adding to Exhibit "A" thereto the <br />fallowing property interest to be acquired in the manner authorized <br />therein: <br />17-44-27-2 4 Thomas C. and Lida O. Murry <br />2401 285 North Bertelsen Road <br />Eugene, oregon 97442 <br />Section 2.
