ORDINANCE No. 19219 <br />AN ORDINANCE CONCERNING PARING CITATIONS; <br />AMENDING SECTIONS 2.770 AND 5.275 QF TIDE <br />EUGENE CQDE, 1971; AND DECI-ARTNG AN EMERGENCY. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLEOwS: <br />Section 1. Subsection ~2~ of Section 2.770 of the Eugene <br />Code, 1971, is hereby amended to read and provide: <br />2.770 <br />~2~ All complaints or citations far traffic viola- <br />tions and traffic offenses issued by a police officer shall <br />contain a form of certificate by the arresting officer to the <br />effect that he certified under penalties provided in ORS <br />484.990 that he has reasonable grounds to believe, and does <br />believe, that the person cited committed the offense contrary <br />to law. Except for citations for parking violations, all <br />other complaints ar citations sha11 be verified by the oath <br />of the party making the same. Citations far violation of <br />parking regulations need not be verified by oath. <br />Section 2. Section 5.275 of the Eugene Code, 1971, is hereby <br />amended to read and provide: <br />5.2?5 Parking Control Officer. Parking control officers are <br />authorized to issue citations and notices of violation <br />of parking provisions of this code to violators, but are not <br />authorized to arrest. Such citations or notices of violation <br />shall be in a form approved by the city attorney and need not <br />be verified by oath. <br />Section 3. Nothing contained herein shall affect the val~.dity <br />of any parking citations issued and outstanding at the time of <br />adoption of this ordinance,. and the Council specifically affirms <br />the parking citations so issued are exempt from the verification <br />requirement of section 2.7 7 0 ~ 2 ~ of the Eugene Code , l9 71. <br />Section 4. That the matters contained herein concern the <br />public welfare and safety and therefore, an emergency is hereby <br />declared to exist, and this ordinance shall become effective im- <br />Ordinance -- 1 <br />
