ORDINANCE N0. ~~~_~ <br />AN ORDINANCE CONCERNING PARKING FACILITIES; <br />AMENDING SECTION 5.540 OF THE EUGENE CODE, <br />1971; AND DECLARING AN EMERGENCY. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. Subsection ~1} of Section 5.540 of the Eugene Code, <br />1971, is hereby amended to read and provide: <br />5.540 <br />~l} As used in this section "parking facility" means <br />any real property or any building or portion thereof, pri- <br />vately or publicly awned, which has been marked with designated <br />parking spaces far motor vehicles, or any real property which <br />has not been marked with designated parking spaces for motor <br />vehicles which by function, custom or usage would cause a rea-~ <br />sonable person to believe it is used for parking motor vehicles. <br />"Parking facility" does not include property within a public <br />way. <br />Section 2. That the matters contained herein concern the <br />public welfare anal safety and therefore, an emergency is hereby de- <br />Glared to exist, and this Ordinance shall become effective immedi~- <br />ately upon its passage by the City Council and approval by the Mayor. <br />Passed by the City Council this <br />day of 1984 <br />~}y~.
