ORDINANCE NO. ~~ <br />AN ORDINANCE CONCERNING TONIC VAPOR OFFE~~~SLS; <br />AMENDING SECTION 4.105 Off' THE EUGENE CODE, 1971; <br />ADDING SECTION 4.230 TO THAT CODE; AND DECLARING <br />AN EMERGENCY. <br />THE CITY OF EUGENE DOES ORDAIN A5 ~`OLLOwS: <br />Section 1. Section 4.105 of the Eugene Code, 1971, is hereby <br />amended by adding in alphabetical order therein a definition for <br />"Toxic vapors ", to read and provide as follows: <br />4.105 <br />Toxic vapors. vapors released from a drug or <br />other substance not a controlled substance as that <br />term i s defined at ORS 4 7 5.0 0 5 ~ 6 ~ , having a propen- <br />sity to release vapors which cause intoxication, <br />inebriation, euphoria, excitement, exhildration, <br />stupefaction or dulling of the senses or nervous <br />system. <br />Section 2. Anew section 4.230 is added to the Eugene Code, <br />1971, to read and provide: <br />4.234 Inhala,n Toxic Vapors Prohibited. No person shall smell <br />or inhale toxic vapors for the purpose of causing a <br />condition of intoxication, inebriation, euphoria, excitement, <br />exhileration, stupefaction or dulling of the senses ar nervous <br />system. <br />Section 3. That the matters contained herein concern the public <br />welfare and safety and therefore, an emergency is hereby declared <br />to exist, and this ordinance shall become effective immediately upon <br />its passage by the Council and approual by the Mayor. <br />Passed by the City Council this <br />day of _ ~ 1984 <br />~S~„~ City Recorder <br />approved by the Mayor this <br />.~ <br />day of , 1984 <br />Mayor <br />Ordinance. <br />
