ORDINANCE ND. 1952 <br />AN ORDINANCE CONCERNING MUNICIPAL COURT; AMENDING <br />SECTIONS 2.175 AND 2.1990 DF THE EUGENE CODE; <br />1971; ADDING SECTIONS 2.811 AND 2.1995 TO THAT <br />CODE; AND DECLARING AN EMERGENCY. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLD~S: <br />Section 1. Section 2.775 of the Eugene Code, 1911, is hereby amended <br />to read and provide: <br />2.775 Munici al Court - Authority. The municipal judge shall have all <br />. inherent statutory powers and duties of a justice of the peace <br />w~ the n the ~ urn sd~ ct~ oval 1 i mi is of the city. The municipal judge may <br />accomplish by any lawful means the serving of subpoenaes, notices of jur <br />duty, summarises and all other orders y <br />of the court necessary for the proper <br />conduct thereof and, within the limit set by the penalty and state law ma <br />prescribe the bai 1 securi t de osi t ~ ~ y <br />Y p fine or forfeiture far v~alat~on of <br />any provision of this code. <br />Section 2. There is hereby added to the Eugene Code, 1971, a new sec- <br />tion, to be numbered and provide: <br />2.811 Munici a1 Court -~ Disre and of Bury Notice. The munici a1 jud e <br />p 9 <br />may hold a prospective juror who disregards the notice of jury <br />duty in contempt of court. <br />Section 3. Section 2.1990 of the Eugene Code, 1971, is hereby amended <br />by deleting subsection (2) therefrom, renumbering the present subsections <br />(3), (4), (5), and (6) to (6), (2), (4), and (5) respectively, and adding a <br />new subsection (3) thereto, to read and provide: <br />2.1990 Penalties -- S ecific. <br />~1} Violation of sections 2.402 to 2.412 and 2.988 is unishable <br />by a fine not to exceed 500 or p <br />~ confinement in jail not to exceed 100 days, <br />or both fine and imprisonment; in addition, the city attorney, upon re uest <br />of the city mono er shall institut G <br />9 ~ e any necessary civil proceedings to <br />enforce the provisions of sections 2.402 to 2.412 and 2.988 of this Code. <br />~2} Violation of a rule of the department of parks and recreation <br />adopted under section 2.$12 et sec. is punishable by a fine not to exceed <br />$500 or confinement in jail not to exceed 30 days, or both such fine and <br />imprisonment. <br />~3} A person found in contempt of court under section 2.811 ma <br />be punished by fine not to exceed y <br />$100 or confinement in.jail riot to exceed <br />20 days or both fine and imprisonment. <br />~4} A violation punishable under section 2.10783}~a is unish- <br />p <br />able by a fine not to exceed $500 for each unit with respect to which the <br />violation has occurred. Each day during which any unit has been advertised <br />or offered or sold and such advertisement or offer or sale has not been <br />withdrawn shall constitute a separate offense. The city attorney's office <br />may apply to any court of competent jurisdiction to enjoin a conversion <br />without a permit found to exist by the city. <br />
