It is now necessary to declare rebates of excess net <br />operating revenues and to direct how such revenues shall be dis- <br />tributed, <br />lz, As required by §2,153 of Eugene Code, 1971, for fiscal <br />year 1984-85, the Downtown Commission has recommended a budget <br />for Downtown Development District activities with the fallowing <br />amounts to be levied on real property and businesses and occupa- <br />tions within the Downtown Development District: <br />Gross levy upon the ownership <br />of real property $19o,00a <br />Gross levy upon businesses and ' <br />occupations $z4z,aoo <br />It appears necessary for the City to levy the above taxes within <br />the Downtown Development District and not elsewhere, <br />13. The City Council has received a legal opinion from <br />Thorp, Dennett, Purdy, Golden & Jewett, P.C., dated January 16, <br />1984, addressed to Ms. Carol James, Department of Finance, City <br />of Eugene, which has interpreted provisions of the Eugene Code, <br />1971, to assist the City Council and staff in making distribution <br />of the funds in the 10th & Gak Overpark Fund ~No, 5z1~ .
