<br />59'-'3 -07 <br />BEFORE THE CITY MANAGER OF THE CITY OF EUGENE <br /> <br />In The Matter of Authorizing the <br />Filing of an Application to Impose <br />and Use and Impose Only a Passenger <br />Facility Charge (PFC) at the <br />Mahlon Sweet Airport (Application) <br />and the Imposition of a $3.00 PFC <br />per Enplaned Passenger to Fund <br />Certain Airport Capital Projects <br />and Authorizing Certain Additional <br />Actions in Conjunction with Filing <br />Said Application and Administering <br />the Subject PFC Program <br /> <br />) <br />) <br />) <br />) <br />) <br />) <br />) <br />) <br />) <br />) <br />) <br />) <br />) <br />) <br /> <br />ORDER AUTHORIZING FILING <br />OF APPLICATION TO IMPOSE <br />A P ASSENGER FACILITY <br />CHARGE (PFC), SETTING A <br />PFC RATE, AND AU1HORIZING <br />CERTAIN ADDIDONALACTION <br /> <br />The City Manager of the City of Eugene finds as follows: <br /> <br />1. The Federal Aviation Administration (FAA) has issued regulations, pursuant <br />to Congressional legislation, authorizing the imposition of a Passenger Facility Charge (PFC) <br />for enplaning passengers at domestic airports. <br /> <br />2. Eugene Code ~ 2.441 establishes ratemaking procedures for the imposition of <br />any fee, charge or rental for the use of Mahlon Sweet Airport. <br /> <br />3. Pursuant to this authority, procedures were initiated for setting the amount of <br />Passenger Facility Charges to assess enplaning passengers using Mahlon Sweet Airport. A <br />Notice of Intended Charges was sent to interested persons. The Notice of Intended Charges <br />was published as provided by law. <br /> <br />4. Comments and inquiries were received from scheduled passenger carriers. No <br />such carriers or other interested persons asserted that the proposed charge was excessive or <br />unreasonable. No request for a hearing was received. <br /> <br />5. Under the Notice of Intended Charges, the PFC to be charged is $3.00 per <br />enplaning passenger.
