<br />ADMINISTRATIVE ORDER NO. 58-94-02-F <br />of the <br />City Manager of the City of Eugene <br /> <br />ESTABLISHING A FEE FOR SYSTEM DEVELOPMENT <br />APPEALS PURSUANT TO SECTION 7.735 OF THE EUGENE CODE, 1971 <br /> <br />The City Manager of the City of Eugene finds as follows: <br /> <br />A. Sections 2.020 and 7.735 of the Eugene, Code, 1971 authorizes the City <br />Manager of the City of Eugene to determine and set fees and charges to be imposed by the <br />City for services, goods, use of municipal property, and licenses and permits, and specifically <br />the fee for appeals of system development charges. <br /> <br />B. In accordance with the procedures set forth therein, on March 4, 1994 I <br />notified the Mayor and City Council that I intended to establish a fee for appeals of system <br />development charges as set forth in the Notice of Intended Fees attached as Exhibit A <br />thereto. The Notice was also posted at two locations at City Hall, and made available for <br />inspection by interested persons at the offices of the City Engineer, 858 Pearl Street, <br />Eugene, Oregon 97401 during normal business hours (8:00 a.m. to 5:00 p.m., Monday <br />through Friday, exclusive of holidays). The Notice provided that written comments would <br />be received thereon for a period of 15 days from the first date of posting. No responses <br />were received within the time or in the manner required by the Notice. <br /> <br />C. I find that an appeal fee of $100 for appeals of system development charges <br />is consistent with applicable policies and directives of the City Council, including those <br />developed during the Eugene Decisions process, the amount charged for comparable <br />appeals, and is necessary in order to recover the costs incurred by the City in processing <br />such appeals. <br /> <br />On the basis of these findings, I order that: <br /> <br />An appeal fee of $100 is hereby established for appeals of system development <br />charges, to become effective April 4, 1994. <br /> <br />Dated thisc.iL day of rN\~ 1994. <br /> <br />(\#~ k\ . <br />\J'" k J "J O---~"--'- ~a <br />Micheal D.
