ORDINANCE NO. 19262 <br />AN ORDINANCE CONCERNING COMMUNITY EVENT SIGNS; AMENDING <br />SECTIONS 8.803 AND 8.670 OF THE EUGENE CODE, 1971; AND <br />DECLARING AN EMERGENCY. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOI~S: <br />Section 1. Section 8,803 of the Eugene Code, 1971, is hereby amended <br />to read and provide: <br />8.8D3 Si n Cade Board of A eal s. <br />~1~ An appeal may be taken from a decision of the building official <br />to the board by a person, firm or corporation affected by a decision of the <br />building official relative to this code, or for special signs as provided in <br />section 8.660, and from a deci si a,n`:~ of the city manager or the manager' s <br />designee fora community event sign under section 8.670. Such appeal shall <br />be taken within 1D days of the decision by filing with the of f i ci a1 whose <br />decision is appealed,.a~notice of appeal, specifying the grounds thereof. <br />The official whose,~decision is being appealed shall forthwith transmit to <br />the board all the papers constituting the record upon which the action <br />appealed from is taken. <br />~2~ An appeal shall stay all proceedings, and furtherance of the <br />action appealed from, unless the building official, city manager, or man <br />ager's designee certifies to the board, after the notice of appeal has been <br />filed with him/her, that by reason of facts stated in the certificate, a <br />stay would, in his/her opinion, cause imminent peril to life or property; in <br />which case the proceedings shall not be stayed otherwise than by a restrain <br />ing order, which maybe granted by the board or by a court having jurisdic <br />tiara of the matter. <br />Section 2, Subparagraph ~j~ of Section 8.670 of the Eugene Code, 1971, <br />is hereby amended to read and provide; <br />8.670 <br />~ j ~ Communi ty,~eyent signs. ~Noncommerci al , nonproduct, or <br />service oriented banners, pennants, and similar signs announcing <br />a community event designated by the city manager or the manager's <br />designee, The community event shall be of community interest <br />with participation available to the general citizenry, and non- <br />commercial and non_political in nature, Provided, however, the <br />location and placement of these signs shall be reviewed by the <br />city sign inspector to ~1} avoid conflict with traffic control <br />signs and devices, ~2~ avoid blocking other permanent signs, and <br />~3} ensure safe construction and installation. These signs may <br />be installed up to 21 days before and may remain in place up to <br />7 days after the designated community event. Community event <br />banners on buildings shall not exceed 10f of the wall area on <br />which located, with a maximum surface area of 25D square feet. <br />A11 other community event banners on private property, or banners <br />across a public street, shall not exceed 1D0 square feet in sur- <br />face area. A decision of the city manager or the manager`s <br />designee may be appealed to the sign code board of appeals in <br />accordance with sections 8.803 and 8,806 of this code. <br />
