ORDINANCE N0. 1~'~~~ <br />AN ORDINANCE CONCERNING ASSAULT AND BATTERY; AMENDING <br />SECTION 4.730 OF THE EUGENE CODE, 1971; ADDING ANEW <br />SECTION 4,729 TD THAT CODE; AND DECLARING AN EMERGENCY. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. There is hereby added to the Eugene Cade, 1971, a new Sec- <br />tion 4.729, to read and provide; <br />4,729 Battery. No person shall by any means, intentionally, knowingly <br />or recklessly: <br />~a) Cause bodily harm to another person, or <br />fib} Make physical contact with another person, which contact <br />is of an offensive nature to a person of ordinary sensibilities. <br />Section 2. Section 4.730 of the Eugene Code, 1971, is hereby amended <br />to read and provide: <br />4.730 Assault. No person shall intentianally, knowingly, or recklessly <br />place or attempt to place another persan in fear of an imminent battery as <br />defined in section 4.729 of this code. <br />Section 3. That the matters contained herein concern the public welfare <br />and safety and therefore, an emergency is hereby declared to exist, and this <br />Ordinance shall become effective immediately upon its passage by the City <br />Council and approval by the Mayor. <br />Passed by the City Council this <br />23rd day of July, 1984 <br />~-u.A,Q..C....
