ORDINANCI3 NO. `q <br />AN ORDINANCE AUTHORISING THE INSTITUTION <br />of PROCEEDINGS IN EMINENT DOMAIN FOR THE <br />ACQUISITION BY CONDEMNATION OF PROFERTY <br />INTERESTS ON FAIRWAY DRIVE FROM HORN LANE <br />To WEST HILLIARD AND ON PARK TERRACE FROM <br />SUNNYSIDE DRIVE TO PARR AVENUE; AMENDING <br />ORDINANCE NO. 19249; AND DECLARING AN <br />EMERGENCY. <br />The City Council of the City of Eugene finds that: <br />By Ordinance No. 19249 passed by the City Council and approved <br />by the Mayor on May 29, 1984 the Council declared the necessit <br />Y <br />of the acquisition of certain real propert interests mare arti <br />y p cu <br />larly described in Exhibit A thereto in order to construct a <br />sanitary sewer pump station, sanitary sewers, force lines and or <br />facilities related thereto in the River Road and Santa Clara <br />areas, and authorized the institution of proceedings in eminent <br />domain for the condemnation of those real property interests. <br />Since adoption of that Ordinance it has been determined <br />that the portions of necessary right of way on Fairwa Drive <br />Y <br />from Horn Lane to West Hilliard and an Park Terrace from Sunn <br />Y <br />side Drive to Park Avenue are not dedicated ublic roads. Th e <br />p <br />acquisition of permanent easements and temporary construction <br />permits are therefore necessary in order to construct the im- <br />provements authorized by Ordinance No. 19249. Now, therefore, <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1.
