<br />ADMINISTRATIVE ORDER NO. 53-02-05 <br />of the <br />Planning & Development Department Executive Director <br />City of Eugene, Oregon <br /> <br />Repealing Administrative Order No. 53-00-01 That <br />Delegated Environmental Review "Certifying Officer" Functions Under <br />CDBG Programs to Planning & Development Department Deputy Director <br /> <br />The Executive Director of the Planning & Development Department of the City of <br />Eugene finds that: <br /> <br />A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 1976, the <br />City Manager is designated as the administrative head of the City, and therefore the "responsible <br />official" or "certifying officer" under 24 CFR S 58.13. <br /> <br />B. On September 23, 1992 the City Manager issued Administrative Order No. 53-92-21 <br />that deleted to the Director of the Planning & Development Department the City Manager's duties <br />and responsibilities as "responsible official" or "certifying officer" regarding environmental review <br />procedures for Federal Programs as set forth in 24 CFR Part 58. That order specifically authorized <br />the Director to delegate all or any of those environmental review duties or responsibilities delegated <br />therein upon a determination that it would be more efficient and in the public interest to do so. <br /> <br />C. Pursuant to that authority, on April 12, 2000 the Executive Director of the Planning <br />& Development Department issued Administrative Order No. 53-00-01 delegating the review and <br />signing of all Environmental Review documents to the Planning & Development Department Deputy <br />Director. <br /> <br />D. The Planning & Development Department Deputy Director position is being <br />eliminated effective July 1, 2002, and Administrative Order No. 53-00-01 should therefore be <br />repealed, as of midnight, June 30, 2002. <br /> <br />Now, Therefore, based on the above findings, which are hereby adopted, <br /> <br />THE EXECUTIVE DIRECTOR OF THE PLANNING & DEVELOPMENT <br />DEPARTMENT OF THE CITY OF EUGENE ORDERS AND DIRECTS THAT: <br /> <br />1. Administrative Order No. 53-00-01, and the authority delegated therein, is repealed <br />effective at midnight, June 30, 2002. <br /> <br />2. Effective July I, 2002, the Executive Director of the Planning & Development <br />Department of the City of Eugene shall perform the City Manager's duties and responsibilities as <br />"responsible official" or "certifying officer" regarding environmental review procedures for Federal <br />Programs as set forth in 24 CFR Part 58 as previously delegated to the Executive Director by <br />Administrative Order No. 53-92-21 of the City Manager of the City of Eugene. <br /> <br />Dated this J 'It!;'day of June, 2002. <br /> <br /> <br />,.!j . <br /> <br /> <br />Tom G.
