<br />GITY FILE NOSh' - gY-t/~ <br /> <br />BEFORE THE CITY MANAGER OF THE CITY OF EUGENE <br /> <br />ADMINISTRATIVE ORDER <br /> <br />The City Manager of the City of Eugene finds as follows: <br /> <br />1. As part of the community Response Team, the City of Eugene <br />proposes to contract with Whitebird Clinic for the performance of <br />services. <br /> <br />2. These services include placing into protective custody and <br />transporting visibly intoxicated persons who are either <br />incapaci tated, whose health is in immediate danger, or who are <br />dangerous to self or to any other person. <br /> <br />3. ORS 426.470 confers a limited immunity for peace officers <br />who are performing these functions. There is a need to minimize <br />the potential liability of the city of Eugene and Whitebird <br />personnel who are engaged in the performance of these services. <br />Commissioning affected personnel performing these functions will <br />allow better control by the city and insulate the City and its <br />agents from some types of liability. <br /> <br />Now, therefore, on the basis on the above findings, IT IS ORDERED <br />THAT: <br /> <br />1. The position of "Transportation Officer" is hereby create.d <br />to exercise the police functions set forth at ORS 426.460 (1) · <br />Prior to any person engaging in those functions on behalf of the <br />City of Eugene, the person shall be commissioned by the Chief of <br />the Department of Public Safety as a special police officer to <br />exercise only those police functions set forth at ORS 426.460(1). <br /> <br />2. Any such delegation of authority shall be revocable at will <br />and shall not authorize the Transportation Officer to exercise <br />any other police function or to carry a firearm in the <br />performance of those duties. The position shall not be a full- <br />time position and may not be held by regular employees of the <br />City of Eugene. Any Transportation Officer shall not receive <br />compensation from the City of Eugene.
