ORDINANCE NO. ~t~ <br />An Ordinance initiating the vacation o~ the following described <br />public utility easement, to--wit: <br />The Southerly se~ren ~7} feet of Lot 3 ~ Block l and <br />the Northerly seven ~7} feet of Lot 4, Block 1, ExCEPT <br />the five foot utility easement a~,ong the Easterly line <br />of Lot 3, Block 1 and the Easterly line of Lot 4, Block <br />l of the Royalwood Subdivision as platted and recorded <br />in File 73, Slide 342, Lane County Oregon Plat Records, <br />Lane County, Oregon. Halvorson/Bennett- EV 81-3} <br />THE CITY OF EUGENE ~DOE.S ORDAIN AS FOLLOWS <br />Section 1, The City Council, of the City of Eugene herein ini- <br />tiates the vacation proceedings vn its own authority without peti- <br />tion o.r consent of the property owners, except as provided by statute, <br />of the above described public utility easement. <br />Section 2. A hearing shall be he;~d upon the proposal to vacate <br />the public utility easement as herein prodded, and the hearing shall <br />be held on the 29th day of July, 1981, at noon Pacific Daylight Time <br />of said date, at the Council Chambers at City Hall, Eugene, Oregon, <br />at which time a~.l persons will be heard upon objections ar sugges- <br />tions with regard to the vacation, and at said time the Council will <br />provide for the vacation of the public ut.l~.ty easement or deny such <br />vacation, and in case the vacation is :made, will provide and make <br />provision for any damages sustained by local assessment. <br />Section 3. The City Recorder is hereby directed to immediately <br />publish once each week for four consecutive weeks in a newspaper pub- <br />lished in Eugene, Lane County, Oregon, notice of .the proposed vaca- <br />tion. The notice shall give a description of the area to be vacated <br />as herein set out; state the date when this ordina,nc,e was passed, the <br />name of any petitioners petitioning for the vacation, and the date <br />Ordinance - 1 <br />
