ORDINANCE N0. 18848 <br />AN ORDINA~!~CF` CC)NCERNING POSSESS~4N OF LIQUOR BY <br />PERSONS UNDER 21 YEARS OF AGE AND THE USE OR POS- <br />SESSION OF LESS THAN ONE OUNCE OF MARIJUANA; <br />AMENDING SECTZ4NS 4.115 AND 4.994 OF THE EUGENE <br />CODE, 1971; ADDING ..A NEw SECTION 4.240 T4 THAT <br />CODE; AND DECLARING AN EMERGENCY. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. Section 4.115 of the Eugene Code, 1971, is amended <br />to read and provide: <br />4.115 Minors -Purchase or Possession of Liquor Prohibited; <br />Exception. <br />~~l} Except as provided in section 4.12D of this code, <br />no minor shall attempt to purchase, purchase, acquire, or have <br />in his or her possession any alcoholic liquor. <br />~2} For the purposes of this section, possession of <br />alcoholic liquor includes the acceptance or consumption of a <br />bottle of such liquor, or any portion thereof, or a drink of <br />such. liquor. The physical act of consuming the alcohol need <br />not occur within the corporate limits of the city. <br />Section 2. There is hereby added to the Eugene Code, 1971, a <br />new section, to be numbered and provide.: <br />4.24 Use or Possession of Less than One Ounce of Mari'uana. <br />~~_1~ No person shall knowingly or intentionally use or <br />possess less than one avoirdupois ounce of the dried leaves, <br />stems and flowers of the plant marijuana unless used or posses- <br />sed pursuant to a prescription valid within the state of Oregon. <br />{2} For purposes of this section, marijuana includes <br />the leaves, stems, flowers and seeds of the plant Cannabis <br />family Moraceae, whether growing or not; but shall not include <br />the resin or oil extracted from any part of such plant, and <br />every compound, manufacture, salty derivative, mixture or pre- <br />paration from such resin or oil, including hashish and natural <br />or synthetic tetrahydrocannabinol; and shall not include the <br />mature stalks of such plant, fiber produced from such stalks, <br />oil or cake made from the seeds of such plant, any other com- <br />pound, manufacture, salt derivative, mixture or preparation of <br />such mature stalks, fiber, oil or cake, or the sterilized seed <br />of such plant which is incapable of germination. <br />Section 3.
