The applicant or develop- <br />er promptly shall notify each affected tenant in writing of the <br />decision of the director on the preliminary permit application. <br />~4} A eal of ermit decision. within 14 days of the <br />permit decision by the director, any interested person may appeal <br />that decision to the hearings officer. Such appeal shall be <br />instituted by filing a notice of appeal on a form to be provided <br />by the city. within l4 days of the notice of appeal, the hear- <br />ings officer sx~~~:ll conduct a hearing on the permit approval or <br />disapproval action a~f the director. Such appeal shall be limit-~ <br />ed to the issues of whether the applicant has satisfied the <br />conditions of the preliminary permit approval and whether the <br />information supplied by the applicant in connection with the <br />application process is true and correct. The decision of the <br />hearings officer on the permit approval or disapproval decision <br />of the director shall be given in writing no later than 10 days <br />after the hearing, and such decision shall be final. An ~re- <br />yp <br />liminary permit approval decision of the director or the hear- <br />ings officer shall be an intermediate and nonffinal order for <br />purposes of judicial review under QRS 34.414 et seg. <br />~:_5} Reapplication. No person, or hip or her agent, <br />who has been denie~d~a preliminary permit for conversion ma <br />y <br />reapply for a permit governing the same condominium or coopera- <br />tive pra~ect within one year of the date of the denial of the <br />application for condominium conversion permit unless there <br />exists a substantial change in conditions which formed the <br />basis of the permit disapproval decision. <br />~;6y ~~piration of preliminary permit.
