aRDTNANCE NO. ~ $~9 <br />AN ORDINANCE CflNCERN`ING THE DOWN~`a'wN DEVELOPMENT <br />DISTRICT; ~MENDTNG SECTIDN 2.3$0 QF 'THE EUGENE <br />CODE, 1971; DECLARING AN EMERGENCY; .AND PROVIDING <br />AN EFFECTIVE DATE. <br />The City Council of the City of Eugene finds .that. <br />Tn 19?2, the Downtown Development District was created for the <br />purpose of financing and administering programs of economic promo- <br />tion and development, public parking, and promotion of all modes of <br />transportation within the central business district. <br />At the time of the creation of the Downtown Development Dis- <br />trict, the property within the District north of 7th Avenue was to <br />be cleared, placed in parking, and offered far future development. <br />Since the creation of the Downtown Development District, the <br />property north of 7th Avenue has been developed with the Eugene <br />Performing Arts Center, the Eugene Conference Center, a hotel, and <br />over 800 off-street parking spaces. <br />The Eugene Performing Arts Center, the Eugene Conference Center, <br />the hotel and parking spaces lay partially within and without the <br />Downtown Development District, necessitating adjustment to the Down- <br />town Development District boundaries by expanding or contracting <br />the boundaries. <br />The Performing Arts Center, Conference Center, hotel and park- <br />ing facilities represent unique, integrated facilities within the <br />community, a significant portion of which are in public ownership <br />and control. <br />The Eugene Performing Arts Center, the Eugene Conference <br />Center, the hotel and parking facilities are integrated physically <br />and their operation and function make it difficult to separate the <br />public and private facilities for taxing purposes. <br />The public facilities owned by the City are not subject to <br />the Downtown Development District taxes and less than one half of <br />the hotel is within the existing boundaries of the District and <br />will be physically separated from the rest of the property within <br />the District by the public conference facilities and a state high- <br />way with high traffic volume. <br />The removal of these facilities from the Downtown Development <br />District will not adversely affect the purposes for which the Dis- <br />trict was created. <br />NoW, THEREFORE, <br />Ordinance - 1 <br />
