<br />ADMINISTRATIVE ORDER NO. 56-00-01-F <br />of the <br />Chief of Police of the City of Eugene <br /> <br />ADOPTION OF PROSTITUTION <br />ADMINISTRATIVE RULE R-4.746 <br /> <br />FREE <br /> <br />ZONE <br /> <br />The City Manager of the City of Eugene finds as follows: <br /> <br />A. Section 2.019 of the Eugene Code, 1971, authorizes the City Manager or designee <br />to adopt rules for administration and implementation of any provisions of that Code. In addition, <br />Section 4.746 of that Code specifically authorizes the Chief of Police (defined in Section 4.750(4) <br />as the City Manager, or the City Manager's designee), in accordance with the procedures of Section <br />2.019 and based on the criteria of Subsection 4.746(1) to designate an area of the City as a <br />prostitution free zone. The Chief of Police has previously been designated by the City Manager as <br />responsible for the administration and enforcement of the provisions of Chapter 4 of the Eugene <br />Code, 1971. <br /> <br />B. Based on the findings set forth in Administrative Order No. 56-00-01 issued on <br />September 26, 2000, I proposed to adopt Administrative Rule R-4.746 relating to the designation <br />of a prostitution free zone area. The adoption of the proposed Prostitution Free Zone Administrative <br />Rule R-4.746 is necessary in order to provide authorization for implementation and enforcement of <br />the provisions of Sections 4.746 to 4.750 of the Eugene Code, 1971. <br /> <br />C. Notice of the proposed adoption was published in the Register Guard for five <br />consecutive days, to-wit, on October 1, 2, 3, 4 and 5, 2000. The Notice was also made available to <br />any person who had requested notice, and provided that written comments would be received thereon <br />for a period of 15 days from the first date of publication. <br /> <br />D. No comments were received within the time or in the manner required in the Notice. <br /> <br />E. Based on the above findings, and the findings in Administrative Order No. 56-00-01, <br />the following Prostitution Free Zone Administrative Rule R-4.746 is hereby adopted: <br /> <br />PROSTITUTION FREE ZONE <br />ADMINISTRATIVE RULE R-4.746 <br /> <br />R-4.746-A <br /> <br />Designation of Area. <br /> <br />On the basis of a determination that during the period of September 21, 1999 through <br />September 21,2000, prostitution-related offenses listed in Section 4.745 of the Eugene Code, 1971 <br />were at least 50% higher in the following described area than for other similarly sized geographic <br /> <br />Administrative Order - 1 <br />c:\ WINDOWS\ TEMP\OOprosfz2ao. wpd <br />
