<br />ADMINISTRATIVE ORDER NO. 57-95-01 <br />of the <br />City Manager <br />City of Eugene. Oregon <br /> <br />DELEGATING RULE MAKING AUTHORITY TO THE EXECUTIVE DIRECTOR <br />OF THE LIBRARY, RECREATION & CULTURAL SERVICES DEPARTMENT. <br /> <br />The City Manager of the City of Eugene finds that: <br /> <br />A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of <br />1976, the City Manager is designated as the administrative head of the City, and is <br />speci fi ca 11 y authori zed to appoi nt and remove all employees (except as otherwi se <br />provided in the Charter). organize, disband. or reorganize City departments, and to <br />enforce all ordinances of the City. <br /> <br />B. Subsection 2.019(1)(h) of the Eugene Code, 1971 authorizes the City Manager <br />or designee to adopt rules for implementation of any provisions of the Eugene Code, <br />1971. Under Subsection 2.1990(2) of that Code, violation of such a rule regulating city <br />parks, recreation or cultural facilities or programs, or other public buildings and <br />facilities owned by the City (including, but not limited to. City Hall, the library, <br />and the Hult Center) is punishable by a fine not to exceed $500 or confinement in jail <br />not to exceed 30 days. or both such fine and imprisonment. <br /> <br />C. Rules currently need to be promulgated and/or revised for use of the City <br />Library. Hult Center, and other recreation or cultural facilities or programs. and it <br />would be more efficient to delegate my rule making authority for the City library. <br />recreation facilities and programs, and City cultural facilities and services to the <br />Executive Director of the Library, Recreation & Cultural Services Department (LRCS). <br /> <br />Now. therefore. based upon the above findings, which are hereby adopted. <br /> <br />The City Manager of the City of Eugene orders and directs that: <br /> <br />1. The Executive Director of the City's Library, Recreation & Cultural <br />Services Department (LRCS) is hereby authorized to adopt rules for the City Library. <br />recreation facilities and programs. and City cultural facilities and programs, in the <br />manner set forth in Section 2.019 of the Eugene Code. 1971. <br /> <br />2. The prior delegation of authority to the Executive Director of LRCS to <br />enforce applicable provisions of the Park Rules, as set forth in Administrative Order <br />No. 58-94-12 is hereby affirmed. <br /> <br />Dated and effective this ~ day Of~, 1995. <br /> <br /> <br />Administrative Order - 1 <br />
