ORDINANCE NO. 8~~°~ <br />AN ORDINANCE AUTHORISING THE INSTITUTION OF PRO- <br />CEEDINGS IN EMINENT DOMAIN FOR THE ACQUISITION <br />BY CONDEMNATION OF PROPERTY INTERESTS AND EASE- <br />~~.ENTS FOR THE PURPOSES OF THE LOCATION AND CON- <br />STRUCTION OF THE OWOSSO BICYCLE/PEDESTRIAN <br />BRIDGE AND RELATED PUBLIC UTILITIES BETWEEN THE <br />EXISTING WILLAKEIri~IE PUMP STATION AND THE <br />REGIONAL SEWAGE TREATMENT PLAINT; A~1D DECLARING <br />AN EMERGENCY. <br />The City Council of the City of Eugene finds that: <br />The City has authority under provisions of the City Charter <br />and applicable state law to institute proceedings in eminent domain <br />for the acquisition by condemnation of private property for public <br />purposes, including the construction of bicycle/pedestrian ways and <br />public utilities. <br />The City of Eugene is in the process of improving bicycle/pedes-- <br />trian ways within the City in order to provide for the safe and effi- <br />dent movement of bicyclists and pedestrians. The proposed Owosso <br />Bridge construction is in compliance with and in furtherance of the <br />City's duly adopted Master Bicycle Plan. <br />Necessary public utilities such as electrical lines, telephone <br />lines, cable television lines, and sewer facilities can be located <br />within the area sought for construction of the bicycle/pedestrian <br />bridge and access for emergency vehicles provided, and it is in the <br />best public interest that provision therefor be made. <br />The location and construction of the Owosso Bridge across the <br />Willamette River between the existing Willakenzie Pump Station and <br />the Regional Sewage Treatment Plant necessitates the acquisition by <br />the City of fee simple title and/or permanent easements, together <br />Ordinance - 1 <br />
