ORDINANCE NO. 8~~°~ AN ORDINANCE AUTHORISING THE INSTITUTION OF PRO- CEEDINGS IN EMINENT DOMAIN FOR THE ACQUISITION BY CONDEMNATION OF PROPERTY INTERESTS AND EASE- ~~.ENTS FOR THE PURPOSES OF THE LOCATION AND CON- STRUCTION OF THE OWOSSO BICYCLE/PEDESTRIAN BRIDGE AND RELATED PUBLIC UTILITIES BETWEEN THE EXISTING WILLAKEIri~IE PUMP STATION AND THE REGIONAL SEWAGE TREATMENT PLAINT; A~1D DECLARING AN EMERGENCY. The City Council of the City of Eugene finds that: The City has authority under provisions of the City Charter and applicable state law to institute proceedings in eminent domain for the acquisition by condemnation of private property for public purposes, including the construction of bicycle/pedestrian ways and public utilities. The City of Eugene is in the process of improving bicycle/pedes-- trian ways within the City in order to provide for the safe and effi- dent movement of bicyclists and pedestrians. The proposed Owosso Bridge construction is in compliance with and in furtherance of the City's duly adopted Master Bicycle Plan. Necessary public utilities such as electrical lines, telephone lines, cable television lines, and sewer facilities can be located within the area sought for construction of the bicycle/pedestrian bridge and access for emergency vehicles provided, and it is in the best public interest that provision therefor be made. The location and construction of the Owosso Bridge across the Willamette River between the existing Willakenzie Pump Station and the Regional Sewage Treatment Plant necessitates the acquisition by the City of fee simple title and/or permanent easements, together Ordinance - 1
