ORDINANCE NO. 1~ <br />An Ordinance initiating the vacation of the fallowing described <br />public utility easement, to-wit: <br />Beginning at the Northwest corner of Lot 11, RON <br />Subdivision, as platted and recorded in Book 69, <br />Page 9, Lane County Oregon Plat Records, in Lane <br />County, Oregon, thence south 5 feet; thence east <br />95.96 feet; thence north 1~ feet; thence west <br />98.96 feet; thence south 5 feet to the point of <br />beginning, all in Lane County, Oregon. ~Ellins <br />Ev 52-2 } <br />THE CITY OF EUGENE DOE" ORDAIN AS FOLLOWS, <br />Section 1. The City Council of the City of Eugene herein ini- <br />bates the vacation proceedings on its own authority without peti- <br />tiara or consent of the property owners, except as provided by statute, <br />~of the above described public utility easement. <br />Section 2. A hearing shall be held upon the proposal to vacate <br />the public utility easement as herein provided, and the hearing <br />shall be held on the 21st day of July, 1982,, at noon Pacific Day- <br />light Time of said date, at the Council Chambers at City Hall, <br />Eugene, Oregon, at which time all persons will be heard upon objec- <br />tions or suggestions with regard to the vacation, and at said time <br />the Council will provide for the vacation of the public utility <br />easement or deny such vacation, and in case the vacation is rude, <br />will provide and make provision for any damages sustained by local <br />assessment. <br />Section 3. The City Recorder is hereby directed to immediately <br />publish once each week for four consecutive weeks in a newspaper pub- <br />lisped in Eugene, Lane County, Oregon, notice of the proposed vaca- <br />tion.
