Z 81-18 <br />ORDINANCE N0. <br />AN ORDINANCE CONCERNING LAND USE CLASSIFICATION AND <br />AMENDING THE ZONING MAP OF THE CITY OF EUGENE, OREGON , <br />AND DECLARING AN EMERGENCY <br />THE CITY COUNCIL OF THE CITY OF EUGENE FINDS THAT: <br />Pursuant to the provisions of ORS 227.215 and Sections 9,278 and 9.668 <br />through 9.684 ofi the Eugene Cade, 1911, the City Counci 1 has the authority <br />and responsibi 1 ity, subject to the 1 imitations contained therein to than e <br />9 <br />the zoning classification of property within the City of Eugene; <br />Based upon the report of the Planning Commission, the materials trans- <br />m~tted therewith, and the evidence presented before the Planning Commission <br />and this City Council, the request far zone change classification is in con- <br />formance with the General Plan; there is a public need for the change in zone; <br />and the public need can best be served by changing the classification of the <br />property; <br />NOW, THEREFORE, <br />Based upon the foregoing, the City Council hereby adopts as its own the <br />spec~f~c affirmative f~nd~ngs contained in the Planning Department staff Hates <br />of December 1, 1981; Planning Commission minutes of January 18, 1982; Cit <br />Counci 1 minutes of A ri 1 12 1 ~ ~ Y <br />p 982; and the Planning Comm~ss~on/City Council <br />findings and minutes of May 17 , 1982, for the reasons set forth therein, <br />and <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS; <br />Section 1. As provided by Section 9.278 of the Eugene Code, 1971, the <br />zon ~ ng map and the zon ~ ng ord ~ n ante sched u 1 e of district changes are hereby <br />amended to reflect the following change of zane: <br />Tax Lot SO6--Assessor's heap 17-4435-3 1 and Tax Lat 101--Assessor's Map <br />17-04-35-3 2, as more particularly described o~ fh~e attached Exhibit "A " <br />1 oc ated vn the south side of West 11th Avenue between B ai 1 e H i 11 Road <br />y <br />and Buck Street, <br />Change of zane from M_2 Light Industrial District to C-21SR Comr~unit <br />y <br />Commercial District with Site Review proved ure~~ addressing concerns as <br />set forth in Exhibit "B," attached . <br />Section 2.
