Z 81-18 ORDINANCE N0. AN ORDINANCE CONCERNING LAND USE CLASSIFICATION AND AMENDING THE ZONING MAP OF THE CITY OF EUGENE, OREGON , AND DECLARING AN EMERGENCY THE CITY COUNCIL OF THE CITY OF EUGENE FINDS THAT: Pursuant to the provisions of ORS 227.215 and Sections 9,278 and 9.668 through 9.684 ofi the Eugene Cade, 1911, the City Counci 1 has the authority and responsibi 1 ity, subject to the 1 imitations contained therein to than e 9 the zoning classification of property within the City of Eugene; Based upon the report of the Planning Commission, the materials trans- m~tted therewith, and the evidence presented before the Planning Commission and this City Council, the request far zone change classification is in con- formance with the General Plan; there is a public need for the change in zone; and the public need can best be served by changing the classification of the property; NOW, THEREFORE, Based upon the foregoing, the City Council hereby adopts as its own the spec~f~c affirmative f~nd~ngs contained in the Planning Department staff Hates of December 1, 1981; Planning Commission minutes of January 18, 1982; Cit Counci 1 minutes of A ri 1 12 1 ~ ~ Y p 982; and the Planning Comm~ss~on/City Council findings and minutes of May 17 , 1982, for the reasons set forth therein, and THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS; Section 1. As provided by Section 9.278 of the Eugene Code, 1971, the zon ~ ng map and the zon ~ ng ord ~ n ante sched u 1 e of district changes are hereby amended to reflect the following change of zane: Tax Lot SO6--Assessor's heap 17-4435-3 1 and Tax Lat 101--Assessor's Map 17-04-35-3 2, as more particularly described o~ fh~e attached Exhibit "A " 1 oc ated vn the south side of West 11th Avenue between B ai 1 e H i 11 Road y and Buck Street, Change of zane from M_2 Light Industrial District to C-21SR Comr~unit y Commercial District with Site Review proved ure~~ addressing concerns as set forth in Exhibit "B," attached . Section 2.
