ORDINANCE N0. ~~ '~ <br />AN ORDINANCE CONCERNING COUNCIL ACTION ON CHANGES <br />IN ZONING DISTRICTS AND DISTRICT REGULATIONS; <br />AMENDING SECTION 9.682 OF THE EUGENE CODES 1971; <br />AND DECLARING AN EMERGENCY. <br />THE CITY of EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. Subsection ~.2 } of Section 9.6 82 of the Eugene Code, <br />1971, is hereby amended to read and provide: <br />9.682 Action of the Council. <br />~2} At such public hearing and after such notice is <br />given, the cauncil shall make specific affirmative findings <br />that: <br />~.a} The proposed change is consistent with and <br />promotes the objectives of the General Plan and of the <br />Zoning Ordinance of the city; <br />fib} There is a public need for a change of the <br />kind in question. It must be demonstrated that: <br />1. Land already available in the zoning <br />classification proposed is unable to be served <br />by adequate public facilities and services, or <br />2. What land is available and served is <br />inadequate or improperly zonedto satisfy the <br />current need for commercial, industrials or in- <br />stitutional uses or for an affordable and desir- <br />able housing inventory, as the case may be; and <br />~c} The location of the proposed change: <br />1. Can be adequately served through the <br />orderly extension of public facilities and ser~ <br />vices and <br />2. Is consistent with the principle of <br />compact and sequential urban growth. <br />The property owner who desires to have his property reclassi- <br />fied has the burden of establishing to the council that the <br />requested classification meets these requirements. <br />Section 2. That the provisions contained herein concern the <br />public welfare, and in order to insure that City regulations are <br />uniformly and consistently applied, an emergency is hereby declared <br />to exist, and this Ordinance shall became effective immediately upon <br />its passage by the City Council and approval by the Mayor. <br />Passed by the City Council this Approved by the Mayor this <br />28 h ay of July, 982 ay of Jul 1982 <br />City Record +~~ayor _. <br />
