oRDZNANCE No. 19n~~ <br />AN ORDINANCE CONCERNING PAYMENT 4F CITY ~3ILLS, <br />AMENDING SECTIQNS 2.525 AND 2.527 of THE EUGENE <br />CODE, 1971; AND DECLARING AN EMERGENCY. <br />The City Council of the City of Eugene finds that: <br />Except as provided by law, whenever an authorized agent of the <br />City executes a contract for material and/or services, the City be- <br />comes committed to pay for the materials and/or services that meet <br />the specifications of the purchase agreement. <br />The Charter provisions and state law on the expenditure of <br />public funds primarily provide a remedy for the City to recover <br />from a public official any unlawful expenditure rather than provide <br />the City with grounds to refuse to pay for materials and services <br />1 <br />it has received. <br />The City Manager, as business agent of the City Council, is <br />authorized to make expenditures and may further delegate that res- <br />r <br />possibility to others in the organization. <br />The City Council establishes its control over expenditures <br />when it adopts the municipal budget appropriating its revenues. <br />It establishes the purposes for which the revenues are "assessed, <br />collected, raised or levied"'. Reasonable controls exist in the <br />state law, the City Charter, and with the City administration to <br />insure the City Manager and his or her designee, will expend public <br />money properly. <br />It will allow the City to mare economically pay its bills and <br />claims if they are paid routinely rather than waiting until City <br />Council meetings. <br />ordinance - 1 <br />
