z 82-10 <br />ORDINANCE N0. ~~_~ <br />AN ORDINANCE CONCERNING LAND USE CLASSIFICATION AND <br />AMENDING THE zONING MAP 4F THE CITY OF EUGENE, OREGON <br />THE CITY COUNCIL OF THE CITY 4F EUGENE FINDS THAT: <br />Pursuant to the provisions of ORS 227.215 and Sections 9.278 and 9,668 <br />through 9.684 of the Eugene Code, 1911, the City Council has the authority <br />and responsibi 1 ity, subject to the 1 imitations contained therein, to change <br />the zoning classification of property within the City of Eugene; <br />Based upon the report of the Planning Commission, the material s.trans- <br />mitted therewith, and the evidence presented before the Planning Commission <br />and this City Council, the request for zone change classification is in con- <br />formance with the General P 1 an; there i s a pub 1 i c need for the change i n zone; <br />and the public need can best be served by changing the classification of the <br />praperty; <br />NOW, THEREFORE, <br />Based upon the foregoing, the City Council hereby adopts as its own the <br />specific affirmative findings contained i n the P 1 ann i ng Department st of f notes <br />of July 24, 1982, and the Planning Commission minutes of July 2O, 1982, for the <br />reasons set forth therein, and <br />THE CITY 4F EUGENE DGES ORDAIN AS FOLLOWS: <br />Section 1, As provided by Section 9.278 of the Eugene Code, 1971, the <br />zone ng map an the zoning ord7 Hance schedule of di strict changes are hereby <br />amended to ref 1 ect the fo 11 owi ng change of zone: <br />Tax Lots 8500 and 8640--Assessor's Map 17-43-32-2 3, and Tax Lots 1140, <br />1240, and 1500--Assessor's Map 17-43-32-2 4, as more particularly described <br />on the attached Exhibit "A", located generally north of 13th Avenue, south <br />of Franklin Boulevard, east of High Street, and .west of Kincaid Street; <br />Change of zone from C-2 Community Commercial to C-21SR Community Com- <br />mercial with Site Review procedures, said site review procedures addressing <br />concerns as set forth i n Exhibit "B" attached . <br />Section 2. The Planning Director is hereby authorized and directed <br />to cause the zoning map and the zoning ordinance schedule of district changes <br />attached to Chapter 9 of the Eugene Code, 1971, to show the foregoing <br />ORDINANCE--Page 1 of 2 <br />
