The original bill increased the penalty for Assault III only for two sets of circumstances <br />by which that crime could be committed if it was caused by a person operating a motor <br />vehicle while under the influence of intoxicants. The amended version expands that <br />enhancement to other sets of circumstances included in the statute (e.g., recklessly <br />causing physical injury to another by means of a deadly or dangerous weapon under <br />circumstances manifesting extreme indifference to the value of human life). <br />We believe that, if a person chooses to operate a motor vehicle while under the influence <br />and subsequently injures a person, the driver should be subject to the enhanced penalty. <br />We believe that this will help to prevent some instances of people electing to do so and, <br />in cases where they opt to drive anyway and cause injury, the change in the law will <br />allow the court to impose a more appropriate sanction. <br />Contact Respondent Dept Updated Priority Policy Poli Numb Recommendation <br />Jeff Perry Jeff Perry CS-FIN 4/17/2009 <br />Comments: Defer to EPD - Does not impact Muni-Court <br />HB 2470 A <br />Relating Clause: Relating to dogs <br />{ - Prohibits owning, possessing, controlling or having charge of more than 25 sexually <br />Title: <br />intact dogs aged four months or older. Imposes conditions for owning, possessing, <br />controlling or having charge of 10 or more sexually intact dogs aged four months or <br />older. Creates exceptions. Makes violation subject to maximum penalty of six months' <br />imprisonment, $2,500 fine, or both. - } { - Imposes requirements and prohibitions on pet <br />dealers selling, bartering or exchanging dogs. Provides customers of pet dealers with <br />specific remedies if dogs have diseases, illnesses, adverse conditions or adverse <br />congenital or hereditary defects. - } { + Prohibits possessing, controlling or having charge <br />of more than 50 sexually intact dogs that are two years of age or older for primary <br />purpose of reproduction. Imposes conditions on persons who possess, control or have <br />charge of certain numbers of sexually intact dogs that are eight months of age or older. <br />Punishes violation by maximum penalty of six months' imprisonment, $2,500 fine, or <br />both. Imposes oversight condition on persons who possess, control or have charge of <br />more than 75 dogs. Provides customers of pet dealers with specific remedies if purchased <br />dog has disease or congenital disorder.
