ORDINANCE NO . ~~ ~y q3 <br />AN ORDINANCE CONCERNING THE COUNCIL HEARING PANEL; <br />AMENDING SECTION 2.447 OF THE EUGENE CODE, 1971; <br />AND DECLARING AN EMERGENCY. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. Subsection ~.9~ of Section 2.447 of the Eugene Code, <br />1971, is amended by adding a new subparagraph ~d} thereto, to pro- <br />vide: <br />2.407 Cit Council _ Meetin s. <br />~9} The council shall establish a hearing panel which <br />shall consist of two councilors, each appointed for three months, <br />to take testimony in appeals to the council regarding: <br />.a_ Street, sidewalk and sewer assessments, <br />~b~ Decisions of the caning board of appeals. <br />~.c~ Decisions of the department of parks and <br />recreation as to its rules. <br />t.dy Recommendations of the city manager with <br />respect to liquor license applications which involve <br />renewal of existing licenses, a greater privilege, <br />or a change of ownership by reason of the addition <br />of or elimination of a partner or change of corpor- <br />ate officers. <br />Such an appeal shall be heard in public session. The panel shall <br />see that a record of the hearing of the appeal before the panel <br />is kept which shall include minutes of the testimony taken, and <br />documents and exhibits received during the hearing. For each such <br />appeal the panel shall prepare a written report of its findings <br />and recommendations. The report shall be submitted to all mem- <br />bers of the council in the week preceding the meeting at which <br />the council takes final action on the appeal. Further testimony <br />regarding the appeal may be received by the council only with <br />the consent of two- thirds of the members of the council. <br />Section 2. That the provisions contained herein concern the <br />public welfare and therefore, an emergency is hereby declared to <br />exist, and this ordinance shall become effective immediately upon <br />its passage by the City Council and approval by the Mayor. <br />Passed by the City Council this <br />5th day of September l9 7 9 <br />-_ ,~ <br />City Reco der <br />Approved by the Mayor this <br />6th day of September 19 79 <br />Mayor <br />Ordinance. <br />
