ORDINANCE NO. _~~J'~ <br />An Ordinance initiating the vacation of the following described <br />bicycle/pedestrian path easement, to-wit: <br />The southerly ten {l~~ feet of Lot 1a5, Oakway First <br />Addition as platted and recorded in Book ~9, Page 31, <br />Lane County Plat Records, in Section 2Q, Township l7 <br />South, Range 3 west, Willamette Meridian, Eugene, Lane <br />County, Oregon. <br />RESERV2NG herein an easement on the ground, above the <br />ground and beneath the ground for purposes of a public <br />utility easement as established as a part of the plat <br />of Fairway View PUD, and the right to enter thereon for <br />purposes of construction, reconstruction and maintenance. <br />REV 79-12 L. J'. Campbell <br />THE CITY OF EUGENE DOE5 ORDAIN AS FOLLOWS: <br />Section 1. The City Council of the City of Eugene herein ini- <br />tiates the vacation proceedings on its own authority without peti- <br />tion or consent of the property owners, except as provided by statute, <br />of the above described bicycle/pedestrian path easement. <br />Section 2. A hearing shall be held upon the proposal to vacate <br />the bicycle/pedestrian path easement as herein provided, and the <br />hearing shall be held on the 2Qth day of February, 1950, at noon <br />Pacific Standard Time of said date, at the Council Chambers at City <br />Hall, Eugene, Qregon, at which time all persons will be heard upon <br />objections or suggestions with regard to the vacation, and at said <br />time the Council will provide for the vacation of the bicycle/ <br />pedestrian path easement or deny such vacation, and in case the <br />vacation is made, will provide and make provision for any damages <br />sustained by local assessments <br />Section 3. The City Recorder is hereby directed to immediately <br />publish once each week for four consecutive weeks in a newspaper pub- <br />lished in Eugene, Lane County, Oregon,~notice of the proposed vaca- <br />Ordinance - 1 <br />
