AIZ 79-13 o~.~~~~~~~cE No. I~ba~ AN ORDINANCE ~C~fCLRNING LAND USE C~.ASSIFICATION AND AMENDING THt ~O~~I"~G MAP OF THE CITY OF EUGENE, OREGON THE CITE COllNCIL D= T;~` CITY OF EUGENE FINDS THAT: Pursuant to thQ provisions of ORS 227.215 and Sections 9.278 and 9.668 through 9.68 of the Eugene Code, 1911, the City Council has the authority and responsibility, sub~p-ct to the limitations contained therein, to change the zoning class~f~cat~on of property within the City of Eugene; Based upon the report of the Planning Commission, the materials trans- m~tted therewith, and the evidence presented before the Planning Commission and this City Council, the request for zone change classification is in conformance with the General Plan; there is a public need. for the change in zone; and the public need can best be served by changing the classification of the ro ert R p p .y~ NOW, THEREFORE, Based upon,the foregoing, the City Council hereby adopts as its own the spec~f~c aff~rmat7ve findings contained in the Planning Department staff notes of February 5, 1980, and the,Planning Departr~ent .supplemental staff notes May l2, 1980, and P1 anni ng Co~nmi scion minutes of February 5, ..1980, and City Council r~i notes of March 24, 1980, and May 12, 1980, for the .reasons set forth therein,, and ~ ~ ~ . THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: . Section 1. As provided by Section 9.278 of the Eugene Code, 1971, the zoning map and the zoning ord~n ante schedule of district changes are hereby amended to ref 1 ect the fo 11 owi ng change of zone. Tax Lot 400-~--Assessor's Map 1803-~18, as more particularly described on the attached exhibit A, located west of Brae Burn Drive, north of Brookside Drive. Change of zone from .County RR Rural Res i dent i a1 District tv City R-1/PD Law~Density Residential District with Planned Unit Development procedures. Section 2. That the zoning designations provided for herein shall become effective upon entry of a Fi nal Order of the Lane County Boundary Comm7ss~on annexing territory described in Exhibit "A" attached hereto.
