1865s <br />application process, elaboration of the. necessary conditions for <br />permit approval, contents of a TA,P contract, the definition. of <br />comparable housing, the selection of a housing counselor, the con- <br />tents of the housing counselor contract, procedural and substantive <br />rules on dispute resolution and enforcement mechanisms, and rules <br />relating to the expiration and revocation of final conversion per- <br />mits <br />Section 11~ ~aiyer b Director of Conditions ~for~Preliminary <br />and k~inal Permit, the Director may exempt a cooperative housing <br />unit project from the pro~risions of this ordinance requiring the <br />provision of a housing code inspection reports the provision of <br />the engineer/architects certificate, and the obligation to exe- <br />cute a TAP contract as conditions for a preliminary permit as <br />well as the provisions of this Ordinance requiring a warranty, <br />warranty security, cash reser~re account, TAP informational reports <br />and certificate of repairs as conditions for a final conversion <br />permit. Such exemptions shall be for any or all o~ the above <br />obligations or conditions. Any such exemption shall be granted <br />only where the operation of federal or state law or an executed <br />regulatory agreement with a federal or state regulatory agency <br />requires the cooperative housing unit project to offer equivalent <br />protection to affected tenants and prospective purchasers and <br />equivalent displacement benefits to relocated tenants as that <br />afforded under this Ordinance. <br />The Director may issue administrati~re rules ~.dentifying such <br />federal or state regulations, laws, or regulatory programs for <br />housing cooperatives, which duplicate or~offer equivalent protec- <br />tion as that afforded under this Ordinance prior to granting any <br />such exemption. Such administrative rulemaking shall solely be <br />initiated upon a petition for rulemakng to the Director of an <br />interested person. Such petitioner must show that the specific <br />benefits under federal. or state regulation are equivalent to the <br />specific benefits granted under this Ordinance. Once these admn- <br />istrative rules have issued, the application of the rules to any <br />preliminary or final permit application shall be determined and <br />adjudicated in the conversion permit process. <br />Section 12. General Provisions. <br />~:a} Anti-discrimination Clause. The developer or owner <br />of any condominium unit within a project shall not discriminate <br />in the sale, or in the terms and conditions of sale of any dwelling <br />unit against any person who was or is a tenant of the building to <br />be converted because such tenant opposed in any manner the con- <br />version of such building to a candon~inium. <br />~b~ Variation b Agreement. Provisions of this Ordi- <br />nonce may not be varied~~~~by agreement and rights conferred by this <br />Ordinance may not be waived prior to the giving of notice of plan- <br />ned conversion.
