ORDINANCE NO. '~ <br />An Ordinance repealing Ordinance No. 1866$ and initiating the <br />vacation of the following described public utility easement, to-wit: <br />The Southerly 7 feet of Lot 8, and the Northerly 7 <br />feet of Lot 19, FOx HOLLOW ESTATES, as platted and <br />recorded in File 73, Slides 70 and 71, Lane County <br />Oregon Plat Records, in Lane County, Oregon.~Jensen EV 8D-1~ <br />T~iE CITY OF EUGENE DoEs ORDAIN A5 FOLLOWS: <br />Section 1. In order to insure an adequate publication time, <br />Ordinance No. 18668 adopted by the Council and approved by the Mayor <br />on June 25, 1984 is hereby repealed. <br />Section 2. The City Council. of the City of Eugene herein ini- <br />tiates the vacation proceedings on its own authority without peti- <br />tion or consent of the property owners, except as provided by statute, <br />of the above described public utility easement. <br />Section 3. A hearing shall be held upon the proposal, to vacate <br />the public utility easement as herein provided, and the hearing shall <br />be held on the 13th day of August, 198Q, at noon, Pacific Daylight <br />Time of said date, at the Council Chambers at City I~all, Eugene, <br />Oregon, at which time all persons will be heard upon objections or <br />suggestions with regard to the vacation, and at said time the Council <br />will provide for the ~'acati,on of the public utility easement or deny <br />such vacation, and in case the vacation is made, will provide and <br />make provision for any damages sustained by focal assessment. <br />Section ~. The City Recorder is hereby directed to immediately <br />publish once each week for four consecutive weeks in a newspaper pub- <br />lished in Eugene, Lane County, Oregon, notice o~ the proposed vaca- <br />tion. The notice shall gave a description of th.e area to be vacated <br />as herein set out; state the. date when this ord%nance was passed, the <br />Ordinance - 1 <br />
