ORDINANCE NO. ~~~ <br />An Ordinance initiating the vacation of the following described <br />easement, to~-wit <br />The northerly 1G feet of a 30 foot storm drainage <br />easement located on and along the southerly boundary <br />of Lots S, 9, lQ, and ll, except for the westerly 7 <br />feet of lot 9 and the easterly 7 f eet of lot l0 , all <br />in Birdnest 5~ubdivision as platted and recorded in <br />File ?3, Slide 35G in Lane County Plat Records, Lane <br />County, Oregon. ~E~ ~0~4 ROGER BIRDS <br />THE CITY OF EUGENE DOES ORDAIN AS FoLLOwS: <br />Section 1. The City Council of the City of Eugene herein ini-- <br />bates the vacation proceedings on its own authority without peti- <br />tion or consent of the property owners, except as provided by statute, <br />of the above described easement. <br />Section 2. A hearing shall be held upon the proposal to vacate <br />the easement as herein provided, and the hearing shall be held on the <br />3rd day of December, 19$4,. at noon Pacific Standard Time of said date, <br />at the Council Chambers at City Hall, Eugene, oregon, at which time <br />all persons will be heard upon ob~eet.ons or suggestions with regard <br />to the vacation, and at said tine the Council will provide for the <br />vacation of the easement or deny such vacation, and in case the vaca- <br />tion is made, will provide and make provision for any damages sus~- <br />tamed by local assessment. <br />Section 3. The City Recorder is hereby directed to immediately <br />publish once each week for four consecutive weeks in a newspaper pub- <br />lished in Eugene, Lane County, Oregon, notice of the proposed vaca- <br />tion. The notice shall give a descript%on of the area to be vacated <br />as herein set out; state the date when this ordinance was passed, the <br />name of any petitioners petitioning far the vacation, and the date <br />ordinance ~- 1 <br />
