Section 4. Section 5.580 of the Eugene Code, 171, is hereby amended to provide:. 5.584 vehicles in Mall ~- Utility Ca~npanies, Private Contrac- tors. ~1} Utility companies which hold franchise agreements with the city may be issued annual permits, which will permit routine access to the pedestrian mall area for inspection of equipment and facilities. These permits shall also specify the access routes, weight of vehicles, and the time that the access may be used. The annual permit shall be issued by the parks and recreation director and no fee wil,1 be charged for the per- mit. Utility companies shall have the same responsibilities and liabilities for their operations within the pedestrian mall. area as other permittees. ~Z~ ~~hen ~ it is necessary for utility companies or pri- vate contractors to open holes in the surface of the mall area for construction of new facilities or repair of existing foci-~ lines, they shall obtain a permit and comply with all require- ments of Chapter 7 of this code. The per~rnit issued by the parks and recreation director shall specify the access requirements as contained in section 5.570. Section 5. That .the provisions contained herein concern the public welfare and safety, and in order to provide for the orderly administration of the issuance of permits an emergency is hereby de- clared to exist and this ordinance shall become effective immediate- ly upon its passage by the City Council and approval by the Mayor.
