ORDINANCE NO. ~ ~ y <br />AN ORDINANCE AUTHORIZING THE INSTITUTION OF PRO- <br />CEEDINGS IN EMINENT DQ'~AIN FOR THE ACQUISITION <br />BY CONDEMNATION OF A PERMANENT EASEMENT FOR THE <br />EXPANSION OF THE WILLAKENZIE SANITARY SEWER PUMP <br />STATION AND CONSTRUCTION OF THE EAST BANK INTER- <br />CEPTOR SEWER FROM THE EXISTING SPRINGFIELD TREAT- <br />MENT PLANT TO THE PROPOSED REGIONAL TREATMENT <br />PLANT; AND DECLARING AN EMERGENCY, <br />The City Council of the City of Eugene finds that: <br />The City Council has authority under provisions of the City <br />Charter and applicable state law to institute proceedings in eminent <br />domain for the acquisition by condemnation of private property for <br />public purposes, including the expansion of the wastewater treatment <br />plant and the construction and improvement of sanitary sewers. <br />The City of Eugene entered into an intergovernmental agreement <br />on February 9, 1977, with the City of Springfield and Lane County to <br />establish a Metropolitan Wastewater Management Commission for the <br />purpose of constructing, operating and maintaining regional sewerage <br />facilities in order to provide safe and efficient treatment of sewage. <br />It is necessary to expand and improve the Willakenzie Sanitary <br />Sewer Pump Station, which necessitates the acquisition of a permanent <br />easement and a temporary construction easement across the real prop- <br />erty hereinafter more particularly described. <br />The proposed improvements are in compliance with and in further- <br />once of the plans and specifications prepared by the City Engineer <br />at the Council's direction and in accordance with provisions of the <br />Eugene Code, 1971, and applicable policies and agreements of the City <br />of Eugene .
