<br /> <br />ECC <br />UGENE ITY OUNCIL <br />AIS <br />GENDA TEM UMMARY <br /> <br /> <br /> <br /> <br /> Public Hearing and Possible Action: An Ordinance Providing for Withdrawal of <br />Territories from the River Road Water District and River Road Park and Recreation <br />District and from the Santa Clara Water District <br /> <br />Meeting Date: March 13, 2006 Agenda Item Number: 8 <br />Department: Planning and Development Staff Contact: Kurt Yeiter <br />www.eugene-or.gov Contact Telephone Number: (541) 682-8379 <br /> <br /> <br /> <br /> <br /> <br />ISSUE STATEMENT <br /> <br />As required by Oregon Revised Statutes, Chapter 222, properties annexed to cities must be withdrawn <br />from some special districts through a separate process after annexation of territories becomes effective. <br />The council is asked to adopt the attached ordinance providing for withdrawal of recently annexed areas <br />from special districts (see Attachment A) immediately following the public hearing. <br /> <br /> <br />BACKGROUND <br />Withdrawals routinely come before the council at least once each year. Properties annexed during <br />previous months are batched together to facilitate this process. This batch consists of all the 2005 and <br />some 2006 annexations for which withdrawal from one or more special districts is necessary. <br /> <br />Maps showing the location of each annexed property subject to withdrawal from one or more special <br />districts are included in this council packet (see Attachment B). <br /> <br />Financial and/or Resource Considerations <br />Failure by the City to withdraw properties from special districts before the County Tax Assessor creates <br />the new tax rolls for the coming year results in the property remaining on the tax roll of the special <br />district that no longer provides service. Withdrawal from special fire districts occurs automatically <br />pursuant to state law. <br /> <br />Timing <br />If the withdrawal ordinance is not effective by March 31, 2006, these properties will remain on the tax <br />roll of the special service districts during the coming fiscal year. Since this is a routine action, staff will <br />request that the council take action following the public hearing on March 13, 2006. <br /> <br />Stakeholder Perspective <br />All annexations were initiated at property owner request, usually to facilitate development.
