METROPOLITAN WASTEWATER MANAGEMENT COMMISSION <br /> <br />RESOLUTION 04-07 ) IN THE MATTER OF APPROVING A <br /> ) SCHEDULE OF REGIONAL WASTEWATER <br /> ) SYSTEM DEVELOPMENT CHARGES AND <br /> ) FORWARDING IT TO THE GOVERNING <br /> ) BODIES FOR IMPLEMENTATION PER THE <br /> ) INTERGOVERNMENTAL AGREEMENT <br /> <br /> WHEREAS, the Metropolitan Wastewater Management Commission (MWMC), <br />pursuant to the Intergovernmental Agreement (IGA) between the cities of Springfield and <br />Eugene, and Lane County, is responsible for administration and operation of the regional <br />wastewater system; and <br /> <br /> WHEREAS, the IGA requires the MWMC to adopt and recommend to the appropriate <br />goveming bodies a system of connection fees that considers different types of usage and that <br />is based on obtaining equality between newly connecting and previously connected users for <br />their contributions toward the regional wastewater system facilities; and <br /> <br /> WHEREAS, ORS 223.297 et. seq. sets forth requirements for the imposition of systems <br />development charges by local govemments; and <br /> <br /> WHEREAS, the MWMC appointed a citizen advisory committee (CAC) to consider and <br />recommend system development charge ($DC) methodology altematives; and <br /> <br /> WHEREAS, on April 1, 2004, after a public hearing, MWMC approved the MWMC <br />Regional Wastewater SDC Methodology (Methodology) and directed that the Methodology be <br />forwarded to the governing bodies for adoption; and <br /> <br /> WHEREAS, on May 6, 2004, after a public headng, MWMC appraoved Resolution 04- <br />04 adoptiong the Facilities Plan and 20-Year Project List (Plan and 20-Year Project List) as <br />part of a process leading to the establishment of regional wastewater system develoment <br />charges; and <br /> <br /> WHEREAS, the regional wastewater System Development Charge Schedule that is <br />attached as Attachment 1 was developed by applying the Methodology to the Plan and 20- <br />Year Project List. <br /> <br /> NOW THEREFORE BE IT RESOLVED BY THE METROPOLITAN WASTEWATER <br />MANAGEMENT COMMISSION THAT: <br /> <br /> 1. The regional wastewater System Development Charge Schedule that is attached <br />as Attachment 1 is approved. <br /> <br /> 2. The General Manager is directed to refer the approved System Development <br />Charge Schedule to the Cities of Eugene and Springfield with MWMC's recommendation that <br /> <br /> <br />
