Petitioner contends that because <br />2Ordinance 20418 increases the required number of parking spaces for multiple family <br />3dwellings in the West University Neighborhood, rather than reducing them, the ordinance is <br />4inconsistent with the policy. <br />5 The city responds in its brief that West University Neighborhood Refinement Plan <br />6Policy 3 was adopted when that refinement plan was adopted in 1982. According to the city, <br />7in 1993 it updated the EC and adopted the requirement that multiple family development <br />8must provide only one off-street parking space per unit. The city contends that there is <br />9evidence in the record that the old one-space off-street parking space standard “was not <br />10working in the University area and it needed to be revised.” Brief of Respondent 17. The <br />11city contends that this “policy does not prohibit the City from revisiting and adjusting the <br />12way in which it has implemented the policy.” Id. <br />11 <br /> West University Refinement Plan Policy 3 provides: <br />“The City of Eugene will update its Land Use Code and that effort shall particularly take into <br />account the need to: <br />“-- reduce non-residential uses permitted in the R-3 and R-4 zones. <br />“-- redefine usable open space. <br />“-- enable infilling on newly created small lots. <br />“-- enable alley access as the primary access to newly created lots. <br />“-- reduce the minimum lot size. <br />“-- increase the flexibility of development standards (for example to enable more <br />efficient use of open space, shared parking,and more extensive use of public rights- <br />of-way). <br />“--review parking requirements for residential development with the purpose of <br />reducing the required number of spaces per unit in the plan area. <br />“-- amend the commercial zoning in the City Code to provide a greater range of <br />commercial zones.” (Emphasis added.) <br />Page 20 <br /> <br />
