Approval of the applicant’s request would re-designate the subject property from <br />Parks and Open Space to Low Density Residential use and make the adopted plan designations <br />consistent with the existing R-1, Low Density Residential zoning of the subject property. Approval of <br />the requests would allow future residential development but does not include a specific development <br />proposal at this time. <br /> <br /> <br />BACKGROUND <br /> <br />The area of this request is the southernmost 28.26 acres of the Lane Memorial Gardens Cemetery, on <br />th <br />Tax Lot 600 of Assessor’s Map 17-04-33-32, located at 5300 West 11 Avenue. The location of the <br />subject property is shown in Exhibits A and B of the attached ordinance. <br /> <br />th <br />The northern portion of the property fronting on West 11 Avenue is developed with a cemetery, and <br />the southern portion proposed for Low Density Residential use is currently undeveloped. A needs <br />analysis recently conducted by the applicant indicated that the portion of the property already developed <br />for cemetery use will be sufficient to address cemetery needs for well over the next one hundred years. <br />Available information indicates that the Parks and Open Space designation was originally applied to the <br />property as part of the Metro Plan process in 1982, due to its pre-existing cemetery use. The proposed <br />re-designation will allow the surplus portion of the cemetery property to be developed with residential <br />uses, consistent with its existing R-1 zoning. <br /> <br />The Planning Commission held a public hearing on the applicant’s request December 8, 2009, and <br />received public testimony from the applicant and applicant’s representatives in favor of the proposal. <br />No opposing testimony was presented. On January 11, 2010, the Planning Commission met for <br />deliberations and voted unanimously to recommend approval of the plan amendments, without the <br />addition of site review overlay zoning. The applicant initially included a zone change request to add site <br />review overlay zoning, but further analysis of the approval criteria showed that there was no policy basis <br />or requirement to add the overlay in this instance.
