ADMINISTRATIVE ORDER NO. AO 44 -06 -02 <br />of the <br />City Manager of the City of Eugene <br />CONCERNING NOTICE OF INTENDED AMENDMENT OF THE <br />TELECOMMUNICATIONS FEE SCHEDULE AND REPEAL OF <br />ADMINISTRATIVE ORDER NO. 44-97-06-F. <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 2.020 and the provisions of Chapter 3 of the Eugene Code, 1971, <br />authorize the City Manager to determine and set fees and charges to be imposed by the <br />City for services, goods, use of municipal property, and licenses and permits. <br />B. Pursuant to that authority, on August 29, 1997, Administrative Order No. <br />44- 97 -06 -F was issued adopting the Telecommunications Fee Schedule. I intend to <br />amend the Telecommunications Fee Schedule by decreasing the initial registration <br />application fee, and removing the fee for initial Telecommunications Plan cost recovery, <br />as set forth in the Notice attached as Exhibit A. The amendments are necessary after <br />evaluating the administrative costs involved in the application process and finding that <br />decreasing the initial registration application fee to $100 would be a more accurate cost <br />recovery. In addition, the initial Telecommunications Plan cost recovery fee should be <br />removed because the fee was originally implemented to recover the estimated costs <br />associated with the development of the Telecommunications Ordinance. Those costs <br />have been recovered and, therefore, the fee should be discontinued. <br />C. In determining the proposed fees set forth in Exhibit A, I have considered <br />the applicable policies, enactments and directives of the City Council, the amount <br />charged for these services by the City in the past, the full costs of providing these <br />services supported by the fees, the amounts charged by other comparable providers, <br />and the revenue needs of the City as determined by the adopted City budget. <br />On the basis of these findings, I order that: <br />1. Copies of the Notice be provided to the Mayor and City Councilors, posted <br />at two locations at City Hall, and be made available for inspection by interested persons <br />at the offices of Information Services Division, 100 W. 10 Avenue, Suite 450, Eugene, <br />Oregon 97401, during normal business hours (8:00 a.m. to 5:00 p.m., Monday through <br />Friday, exclusive of holidays). <br />2. All persons desiring to comment on the proposed fee amendments shall <br />submit written comments as set forth in the Notice.
