ADMINISTRATIVE ORDER NO. 53 -10 -08 <br />of the <br />City Manager of the City of Eugene <br />PROPOSING THE AMENDMENT OF APPEAL FEES IN THE LAND USE <br />APPLICATION FEE SCHEDULE ESTABLISHED BY <br />ADMINISTRATIVE ORDER NOS. 53- 05 -084 53- 07 -11 -F, 53- 09 -03 -F AND <br />53- 10 -05 -F. <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 2.020 and the provisions of Chapter 9 of the Eugene Code, 1971, <br />authorize the City Manager to determine and set fees and charges to be imposed by the City for <br />services, goods, use of municipal property, and licenses and permits. <br />B. In accordance with the above provisions, 'land use application fees have been <br />established by Administrative Order No. 53- 05 -08 -F, and amended by Administrative order Nos. <br />53- 07 -11 -F, 53- 09 -03 -F and 53- 10 -05 -F. <br />C. Staff has recommended amending the appeal fees in the Land Use Application <br />Fee Schedule because the City wishes to ensure that Eugene's land use appeal fees continue to be <br />reflective of the average actual cost to the City of preparing and conducting such appeals. By <br />adopting appeal fees that require an appellant to pay for the actual of its specific land use <br />appeal, the City will ensure consistency with Oregon law and obtain data from its most recent <br />appeals. This data will enable the City to, at a later time, consider adoption of updated appeal <br />fees in specific dollar amounts that reflect the average cost of those appeals. <br />D. Based on staff's recommendation, I intend to amend the Land Use Application <br />Fee Schedule as set forth on the Notice attached as Exhibit A to this order. <br />E. In determining the fees, I have considered the applicable policies, enactments and <br />directives of the City Council, the amount charged for similar services by the City in the past, the <br />full costs of providing the services supported by the fees, the amounts charged by other <br />comparable providers, and the revenue needs of the City as determined by the adopted City <br />budget. <br />On the basis of these findings, I order that: <br />1. Copies of the Notice attached as Exhibit A to this order are to be provided to the <br />Mayor and City Councilors, posted at two locations at City Hall, published in the Register -Guard <br />Newspaper, be made available to persons who have requested such notice, and be made available <br />for inspection by interested persons at the Planning & Development Department, Planning <br />Administrative order - Page 1 of 2 <br />
