Therefore, it would be very difficult to determine if <br />the subject had been convicted prior to a new possession. It is likely, then, that police <br />would consistently "over charge" defendants creating a bad situation for the defendant, <br />but also creating more work for prosecutors who would have to change the original <br />paperwork and court filings.
